111Cessation of duties in relation to category 3 young people

A responsible local authority’s duties towards a category 3 young person cease when the young person reaches the age of 21, except in the circumstances set out in subsection (2).

Where the category 3 young person’s pathway plan sets out a programme of education or training which extends beyond the date on which he or she reaches the age of 21—
a
the duties under section 110(1)(b) and (c), (6) and (9) continue until the young person ceases to pursue that programme, and
b
the duties under sections 105, 106 and 107(3) and (10) continue concurrently with those duties and cease at the same time.

For the purposes of subsection (2)(a), the responsible local authority must disregard any interruption in the young person’s pursuance of a programme of education or training if it is satisfied that the young person will resume the programme as soon as is reasonably practicable.
