Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Cofnodir newidiadau ac effeithiau gan ein tîm golygyddol mewn rhestrau sydd i'w gweld yn yr adran 'Newidiadau i Ddeddfwriaeth'. (1)Yn ddarostyngedig i ddarpariaethau canlynol yr adran hon, ni chaniateir i blentyn sy’n derbyn gofal gan awdurdod lleol neu awdurdod lleol yn Lloegr gael ei leoli, ac os yw wedi ei leoli, ni chaniateir iddo gael ei gadw mewn llety yng Nghymru a ddarperir at y diben o gyfyngu ar ryddid (“llety diogel”) onid yw’n ymddangos—

(a)bod y plentyn—

(i)yn un sydd â hanes o ddianc a’i fod yn debyg o ddianc o lety o unrhyw ddisgrifiad arall, a

(ii)yn debyg o ddioddef gan niwed o bwys os yw’n dianc, neu

(b)bod y plentyn, os yw’n cael ei gadw mewn llety o unrhyw ddisgrifiad arall, yn debyg o anafu ei hun neu bersonau eraill.

(2)Caiff Gweinidogion Cymru drwy reoliadau—

(a)pennu—

(i)cyfnod na chaniateir i blentyn gael ei gadw y tu hwnt iddo mewn llety diogel yng Nghymru heb awdurdod y llys, a

(ii)y cyfnod hwyaf y caiff y llys awdurdodi bod plentyn yn cael ei gadw amdano mewn llety diogel yng Nghymru;

(b)rhoi pŵer i’r llys i awdurdodi o bryd i’w gilydd fod plentyn yn cael ei gadw mewn llety diogel yng Nghymru am unrhyw gyfnod pellach y bydd y rheoliadau yn ei bennu;

(c)darparu bod ceisiadau i’r llys o dan yr adran hon i’w gwneud gan awdurdod lleol [F1neu awdurdod lleol yn Lloegr] yn unig.

(3)Mae’n ddyletswydd ar lys sy’n gwrando cais o dan yr adran hon i ddyfarnu a yw unrhyw feini prawf perthnasol ar gyfer cadw plentyn mewn llety diogel wedi eu bodloni yn achos y plentyn.

(4)Os bydd llys yn dyfarnu bod unrhyw feini prawf o’r fath wedi eu bodloni, rhaid iddo wneud gorchymyn yn awdurdodi bod y plentyn i’w gadw mewn llety diogel ac yn pennu’r cyfnod hwyaf ar gyfer cadw’r plentyn felly.

(5)Os caiff gwrandawiad cais o dan yr adran hon ei ohirio, caiff y llys wneud gorchymyn interim yn caniatáu i’r plentyn gael ei gadw mewn llety diogel yn ystod cyfnod y gohiriad.

(6)Ni chaiff unrhyw lys arfer y pwerau a roddwyd gan yr adran hon mewn cysylltiad â phlentyn nad yw wedi ei gynrychioli’n gyfreithiol yn y llys hwnnw, oni bai ei fod, ar ôl cael ei hysbysu am ei hawl i wneud cais am [F2y ddarpariaeth o gynrychiolaeth o dan Ran 1 o Ddeddf Cymorth Cyfreithiol, Dedfrydu a Chosbi Troseddwyr 2012] ac wedi cael cyfle i wneud hynny, wedi gwrthod neu wedi methu â gwneud cais.

(7)Caiff Gweinidogion Cymru, drwy reoliadau, ddarparu—

(a)bod yr adran hon i’w chymhwyso neu nad yw i’w chymhwyso i unrhyw ddisgrifiad o blant a bennir yn y rheoliadau;

(b)bod yr adran hon yn cael effaith mewn perthynas â phlant o ddisgrifiad a bennir yn y rheoliadau yn ddarostyngedig i addasiadau a bennir yn y rheoliadau;

(c)bod darpariaethau eraill a bennir yn y rheoliadau i gael effaith at ddibenion dyfarnu a ganiateir i blentyn o ddisgrifiad a bennir yn y rheoliadau gael ei leoli neu ei gadw mewn llety diogel yng Nghymru.

(8)Nid yw rhoi awdurdodiad o dan yr adran hon yn rhagfarnu unrhyw bŵer sydd gan unrhyw lys yn Lloegr a Chymru i roi cyfarwyddiadau ynglŷn â’r plentyn y mae’r awdurdodiad yn ymwneud ag ef.

(9)Nid yw rhoi awdurdodiad o dan yr adran hon yn rhagfarnu effaith unrhyw gyfarwyddyd a roddir gan lys yn yr Alban ynglŷn â phlentyn y mae’r awdurdodiad yn ymwneud ag ef, i’r graddau y mae’r cyfarwyddyd yn cael effaith yng nghyfraith Lloegr a Chymru.

(10)Mae’r adran hon yn ddarostyngedig i adran 76(5).
