68Dyletswydd interim i sicrhau llety ar gyfer ceiswyr digartref mewn angen blaenoriaethol

(1)Rhaid i’r awdurdod tai lleol sicrhau bod llety addas ar gael i’w feddiannu gan geisydd y mae is-adran (2) neu (3) yn gymwys iddo hyd nes y daw’r ddyletswydd i ben yn unol ag adran 69.

(2)Mae’r is-adran hon yn gymwys i geisydd y mae gan yr awdurdod reswm i gredu y gallai fod—

(a)yn ddigartref,

(b)yn gymwys i gael cymorth, a

(c)ag angen blaenoriaethau am lety,

o dan amgylchiadau pan nad yw’r awdurdod yn fodlon hyd yma bod y ceisydd yn ddigartref, yn gymwys i gael cymorth ac ag angen blaenoriaethol am lety.

(3)Mae’r is-adran hon yn gymwys i geisydd—

(a)y mae’r awdurdod â rheswm i gredu neu yn fodlon bod ganddo angen blaenoriaethol neu y mae ei achos wedi cael ei atgyfeirio gan awdurdod tai lleol yn Lloegr o dan adran 198(1) o Ddeddf Tai 1996, a

(b)y mae’r ddyletswydd yn adran 73 (dyletswydd i gynorthwyo i ddod â digartrefedd i ben) yn gymwys iddo.

(4)Mae’r ddyletswydd o dan yr adran hon yn codi pa un a oes unrhyw bosibilrwydd o atgyfeirio achos y ceisydd at awdurdod arall ai peidio (gweler adrannau 80 i 82).
