81Cysylltiad lleol

(1)Mae’r adran hon yn gymwys at ddibenion y Bennod hon.

(2)Mae gan berson gysylltiad lleol ag ardal awdurdod tai lleol yng Nghymru neu yn Lloegr os oes gan y person gysylltiad â hi—

(a)gan fod y person yn preswylio yno fel arfer, neu wedi gwneud hynny yn y gorffennol, a bod y preswyliad hwnnw o ddewis y person ei hun,

(b)gan fod y person yn cael ei gyflogi yno,

(c)o ganlyniad i gysylltiadau teuluol, neu

(d)o ganlyniad i amgylchiadau neilltuol.

(3)Nid yw preswyliad mewn ardal o ddewis person ei hun os yw’r person, neu berson y gellid disgwyl yn rhesymol iddo breswylio gyda’r person hwnnw, yn dod yn breswyliwr yno gan fod y person yn cael ei gadw o dan awdurdod deddfiad.

(4)Caiff Gweinidogion Cymru bennu drwy orchymyn yr amgylchiadau hynny—

(a)pan nad yw person i gael ei drin fel person a gyflogir mewn ardal, neu

(b)pan nad yw preswyliad mewn ardal i gael ei drin fel preswyliad o ddewis person ei hun.

(5)Mae gan berson gysylltiad lleol ag ardal awdurdod tai lleol yng Nghymru neu yn Lloegr os darparwyd llety i’r person yn yr ardal honno (ar unrhyw adeg) o dan adran 95 o Ddeddf Mewnfudo a Lloches 1999 (cefnogaeth i geiswyr lloches).

(6)Ond nid yw is-adran (5) yn gymwys—

(a)i ddarparu llety i berson yn ardal awdurdod tai lleol os darparwyd llety i’r person yn ardal awdurdod tai lleol arall wedi hynny o dan adran 95 o’r Ddeddf honno, neu

(b)i ddarparu llety mewn canolfan letya yn rhinwedd adran 22 o Ddeddf Cenedligrwydd, Mewnfudo a Lloches 2002 (defnyddio canolfannau lletya ar gyfer cefnogaeth adran 95).
