Changes to Legislation

Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
86Gweithdrefn ar gyfer adolygiadLL+C
(1)Caiff Gweinidogion Cymru wneud darpariaeth drwy reoliadau ynghylch y weithdrefn i’w dilyn mewn perthynas ag adolygiad o dan adran 85.
(2)Caiff rheoliadau o dan is-adran (1) wneud y canlynol, er enghraifft,—
(a)ei gwneud yn ofynnol i’r penderfyniad ar adolygiad gael ei wneud gan berson ar y lefel briodol nad oedd yn ymwneud â’r penderfyniad gwreiddiol, a
(b)darparu ar gyfer yr amgylchiadau lle bydd y ceisydd â’r hawl i wrandawiad llafar, ac a ganiateir yr hawl i’r ceisydd gael ei gynrychioli mewn gwrandawiad o’r fath, a chan bwy, a
(c)darparu ar gyfer y cyfnod y mae’n rhaid cynnal yr adolygiad a rhoi hysbysiad ynghylch y penderfyniad ynddo.
(3)Rhaid i’r awdurdod perthnasol, neu yn ôl y digwydd y naill neu’r llall o’r awdurdodau perthnasol, hysbysu’r ceisydd am y penderfyniad ynghylch yr adolygiad.
(4)Rhaid i’r awdurdod hefyd hysbysu’r ceisydd am y rhesymau dros y penderfyniad, os yw’r penderfyniad—
(a)yn cadarnhau’r penderfyniad gwreiddiol ar unrhyw fater yn groes i fuddiannau’r ceisydd, neu
(b)yn cadarnhau y cafodd camau rhesymol eu cymryd.
(5)Pa fodd bynnag, rhaid iddynt hysbysu’r ceisydd am ei hawl i apelio i’r llys sirol ar bwynt cyfreithiol, ac am y cyfnod y mae’n rhaid cyflwyno apêl o’r fath ynddo (gweler adran 88).
(6)Ni chaniateir trin hysbysiad am y penderfyniad fel un sydd wedi ei roi oni chydymffurfir ag is-adran (5), a phan fo hynny’n gymwys is-adran (4), a hyd nes y gwneir hynny.
(7)Rhaid i hysbysiad y mae’n ofynnol ei roi i berson o dan yr adran hon gael ei roi yn ysgrifenedig ac, os nad yw’n dod i law’r person hwnnw, gael ei drin fel pe bai wedi ei roi os yw ar gael yn swyddfa’r awdurdod am gyfnod rhesymol i’w gasglu gan y person neu ar ran y person.
