89Apelau yn erbyn gwrthodiad i letya wrth aros am apêl

(1)Mae’r adran hon yn gymwys pan fo gan geisydd yr hawl i apelio i’r llys sirol o dan adran 88.

(2)Caiff ceisydd apelio i’r llys sirol yn erbyn penderfyniad yr awdurdod—

(a)i beidio ag arfer ei bŵer o dan adran 88(5) (“y pŵer adran 88(5)”) yn achos y ceisydd,

(b)i arfer y pŵer hwnnw am gyfnod cyfyngedig sy’n dod i ben cyn penderfyniad terfynol y llys sirol ynghylch apêl y ceisydd o dan adran 88(1) (“y brif apêl”), neu

(c)i roi’r gorau i arfer y pŵer hwnnw cyn y penderfyniad terfynol.

(3)Ni chaniateir cyflwyno apêl o dan yr adran hon wedi i’r llys sirol wneud ei benderfyniad terfynol ar y brif apêl.

(4)Mewn apêl o dan yr adran hon—

(a)caiff y llys orchymyn yr awdurdod i sicrhau bod llety addas ar gael i’r ceisydd ei feddiannu hyd nes y penderfynir ar yr apêl (neu hyd y cyfryw amser cynharach ag y caiff y llys ei bennu), a

(b)rhaid i’r llys gadarnhau neu ddiddymu’r penderfyniad y cyflwynwyd apêl yn ei erbyn.

(5)Wrth ystyried pa un ai i gadarnhau neu i ddiddymu’r penderfyniad rhaid i’r llys gymhwyso’r egwyddorion a gymhwysa’r Uchel Lys mewn cais am adolygiad barnwrol.

(6)Os diddyma’r llys y penderfyniad caiff orchymyn yr awdurdod i arfer y pŵer adran 88(5) yn achos y ceisydd am y cyfryw gyfnod ag y ceir ei bennu yn y gorchymyn.

(7)Yn achos gorchymyn o dan is-adran (6)—

(a)caniateir gwneud gorchymyn dim ond os yw’r llys yn fodlon y byddai methu ag arfer y pŵer adran 88(5) yn unol â’r gorchymyn yn rhagfarnu yn sylweddol allu’r ceisydd i fwrw ymlaen â’r brif apêl;

(b)ni chaiff gorchymyn bennu unrhyw gyfnod sy’n dod i ben ar ôl i’r llys sirol wneud ei benderfyniad terfynol ar y brif apêl.
