25Cyfarwyddydau i Banel Annibynnol Cymru ar Gydnabyddiaeth Ariannol i gyflawni swyddogaethau perthnasol

(1)Caiff Gweinidogion Cymru gyfarwyddo Panel Annibynnol Cymru ar Gydnabyddiaeth Ariannol (“y Panel”) fod yn rhaid iddo gyflawni’r swyddogaethau perthnasol—

(a)mewn perthynas ag awdurdod cysgodol, a

(b)mewn perthynas â phrif awdurdod lleol ar gyfer y flwyddyn ariannol gyntaf y bydd yn brif awdurdod lleol yn rhinwedd rheoliadau uno neu ddarpariaethau Deddf Cynulliad Cenedlaethol Cymru.

(2)Y swyddogaethau perthnasol yw’r swyddogaethau o dan—

(a)adran 142 (pwerau a dyletswyddau sy’n ymwneud â thaliadau i aelodau), a

(b)adran 143 (swyddogaethau sy’n ymwneud â phensiynau aelodau),

o Fesur Llywodraeth Leol (Cymru) 2011.

(3)Mae Rhan 8 o’r Mesur hwnnw yn gymwys, felly, yn achos awdurdod cysgodol y rhoddwyd cyfarwyddyd mewn perthynas ag ef o dan is-adran (1)(a) (am ba hyd bynnag ag y bydd y cyfarwyddyd yn cael effaith) fel pe bai’n awdurdod perthnasol o fewn ystyr y Rhan honno o’r Mesur hwnnw; ond wrth ei gymhwyso yn rhinwedd yr is-adran hon mae Rhan 8 yn cael effaith yn ddarostyngedig i—

(a)yr addasiadau yn is-adran (4), a

(b)adran 26.

(4)Dyma’r addasiadau—

(a)yn adran 142(8) (ystyriaeth i gael ei rhoi i’r effaith ariannol ar awdurdodau perthnasol), mae’r cyfeiriad at “awdurdodau perthnasol” i gynnwys awdurdodau cysgodol, a

(b)mae’r pŵer i adroddiad blynyddol osod gofynion o dan adran 150(1) (osgoi dyblygu taliadau etc.) i fod yn ddyletswydd i adroddiad blynyddol neu adroddiad atodol osod y gofynion hynny.

(5)Wrth arfer swyddogaethau yn rhinwedd yr adran hon mewn perthynas â’r flwyddyn ariannol gyntaf y mae awdurdod yn brif awdurdod lleol yn rhinwedd rheoliadau uno, caiff y Panel—

(a)gwneud penderfyniadau gwahanol o dan adran 142(1),

(b)pennu symiau gwahanol o dan adran 142(3),

(c)gwneud penderfyniadau gwahanol o dan adran 142(4),

(d)gosod canrannau gwahanol neu gyfraddau neu fynegrifau eraill o dan adran 142(6), ac

(e)gwneud penderfyniadau gwahanol o dan adran 143(2) a (3),

mewn perthynas ag amserau cyn y bydd y prif awdurdod lleol yn cynnwys cynghorwyr a etholir yn yr etholiad cyffredin cyntaf ar gyfer cynghorwyr ac wedi hynny.
