28Datganiadau polisi tâl

(1)Rhaid i bwyllgor pontio a sefydlir gan awdurdodau sy’n uno gyhoeddi argymhellion o ran y datganiadau polisi tâl sydd i’w paratoi gan yr awdurdod cysgodol ar gyfer y brif ardal y mae eu prif ardaloedd i gael eu huno i’w chreu.

(2)Rhaid cyhoeddi’r argymhellion yn ddim hwyrach na 42 o ddyddiau cyn y dyddiad y sefydlir yr awdurdod cysgodol neu y cynhelir etholiadau ar gyfer yr awdurdod cysgodol.

(3)Rhaid i awdurdod cysgodol baratoi a chymeradwyo datganiad polisi tâl (a chaiff ei ddiwygio) yn unol ag adrannau 38(2) i (5) a 39(1), (4) a (5) o Ddeddf Lleoliaeth 2011—

(a)ar gyfer y cyfnod sy’n dechrau â chymeradwyo’r datganiad polisi tâl ac sy’n dod i ben yn union cyn y dyddiad trosglwyddo, a

(b)ar gyfer y flwyddyn ariannol gyntaf y bydd prif awdurdod lleol ar gyfer y brif ardal newydd.

(4)Ni chaniatier i awdurdod cysgodol benodi neu ddynodi prif swyddog (o fewn ystyr adran 43(2) of Ddeddf Lleoliaeth 2011) hyd nes y bydd y datganiad polisi tâl o dan is-adran (3)(a) wedi ei baratoi a’i gymeradwyo.

(5)Mae adrannau 38(2) i (5) a 39(1), (4) a (5), 41(1) a (2) a 42(1) a (2) o Ddeddf Lleoliaeth 2011 yn gymwys yn unol â hynny ond fel pe bai’r awdurdod cysgodol yn awdurdod perthnasol a’r cyfnod a grybwyllir yn is-adran (3)(a) yn flwyddyn ariannol.

(6)Caiff Gweinidogion Cymru ddyroddi canllawiau ynghylch cyflawni dyletswyddau a osodir gan yr adran hon a rhaid i bwyllgorau pontio ac awdurdodau cysgodol, wrth gyflawni dyletswyddau a osodir gan yr adran hon, roi sylw i unrhyw ganllawiau o’r fath.
