Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. 118Cosb am fethu â dychwelyd ffurflen dreth ar y dyddiad ffeilio neu cyn hynnyLL+C

[F1(1)] Mae person [F2y mae’n ofynnol iddo ddychwelyd ffurflen dreth] yn agored i gosb o £100 os yw’r person yn methu â dychwelyd ffurflen dreth ar y dyddiad ffeilio neu cyn hynny.

[F4118ACosbau am fethiannau lluosog i ddychwelyd ffurflenni treth mewn cysylltiad â threth gwarediadau tirlenwiLL+C

(1)Pan ddaw person yn agored i gosb o dan adran 118 mewn cysylltiad â ffurflen dreth y mae’n ofynnol i’r person ei dychwelyd o dan adran 39 o DTGT, mae cyfnod cosbi—

(a)yn dechrau â’r diwrnod ar ôl dyddiad ffeilio’r ffurflen dreth, a

(b)yn dod i ben 12 mis yn ddiweddarach, oni chaiff ei ymestyn o dan is-adran (2)(b).

(2)Os yw’n ofynnol i’r person ddychwelyd ffurflen dreth arall o dan adran 39 o DTGT (“ffurflen dreth B”) cyn diwedd y cyfnod cosbi ond bod y person yn methu â gwneud hynny ar ddyddiad ffeilio ffurflen dreth B neu cyn hynny—

(a)nid yw’r person yn agored i gosb o dan adran 118 mewn cysylltiad â’r methiant hwnnw ond mae’n agored i gosb o dan yr adran hon yn lle hynny, a

(b)caiff y cyfnod cosbi ei ymestyn fel ei fod yn dod i ben 12 mis ar ôl dyddiad ffeilio ffurflen dreth B.

(3)Pennir swm y gosb y mae person yn agored iddo o dan yr adran hon drwy gyfeirio at nifer y ffurflenni treth—

(a)yr oedd yn ofynnol i’r person eu dychwelyd o dan adran 39 o DTGT yn ystod y cyfnod cosbi, ond

(b)y mae’r person wedi methu â’u dychwelyd ar ddyddiadau ffeilio’r ffurflenni treth hynny neu cyn hynny.

(4)Os methiant cyntaf y person yn ystod y cyfnod cosbi yw’r methiant i ddychwelyd ffurflen dreth B ar y dyddiad ffeilio neu cyn hynny, mae P yn agored i gosb o £200 mewn cysylltiad â’r methiant hwnnw.

(5)Os ail fethiant y person yn ystod y cyfnod cosbi yw’r methiant i ddychwelyd ffurflen dreth B ar y dyddiad ffeilio neu cyn hynny, mae P yn agored i gosb o £300 mewn cysylltiad â’r methiant hwnnw.

(6)Os trydydd methiant neu ragor y person yn ystod y cyfnod cosbi yw’r methiant i ddychwelyd ffurflen dreth B ar y dyddiad ffeilio neu cyn hynny, mae P yn agored i gosb o £400 mewn cysylltiad â’r methiant hwnnw.

(7)Caniateir ymestyn cyfnod cosbi fwy nag unwaith o dan is-adran (2)⁠(b).]

119Cosb am fethu â dychwelyd ffurflen dreth o fewn 6 mis wedi’r dyddiad ffeilioLL+C

(1)Mae person [F5y mae’n ofynnol iddo ddychwelyd ffurflen dreth] yn agored i gosb os yw methiant y person i ddychwelyd ffurflen dreth yn parhau ar ôl diwedd y cyfnod o 6 mis sy’n dechrau â’r diwrnod ar ôl y dyddiad ffeilio.

(2)Y gosb yw’r mwyaf o’r canlynol—

(a)5% o swm y dreth ddatganoledig y byddai’r person wedi bod yn agored i’w dalu pe byddai’r ffurflen dreth wedi ei dychwelyd, a

(b)£300.

120Cosb am fethu â dychwelyd ffurflen dreth o fewn 12 mis wedi’r dyddiad ffeilioLL+C

(1)Mae person [F6y mae’n ofynnol iddo ddychwelyd ffurflen dreth] yn agored i gosb os yw methiant y person i ddychwelyd ffurflen dreth yn parhau ar ôl diwedd y cyfnod o 12 mis sy’n dechrau â’r diwrnod ar ôl y dyddiad ffeilio.

(2)Pan fo’r person, drwy fethu â dychwelyd y ffurflen dreth, yn atal yn fwriadol wybodaeth a fyddai’n galluogi neu’n cynorthwyo ACC i asesu rhwymedigaeth y person i dreth ddatganoledig, y gosb [F7yw—

(a) £300, neu

(b) swm uwch, heb fod yn fwy na 95% o’r swm o dreth ddatganoledig y byddai’r person wedi bod yn agored i’w dalu pe byddai’r ffurflen dreth wedi ei dychwelyd.]

(3)Mewn unrhyw achos nad yw’n dod o fewn is-adran (2), y gosb yw’r mwyaf o’r canlynol⁠—

(a)5% o swm y dreth ddatganoledig y byddai’r person wedi bod yn agored i’w dalu pe byddai’r ffurflen dreth wedi ei dychwelyd, a

(b)£300.

121Gostwng cosb am fethu â dychwelyd ffurflen dreth: datgeluLL+C

(1)Caiff ACC ostwng cosb o dan adran 118, [F8118A,] 119 neu 120 os yw’r person yn datgelu gwybodaeth sydd wedi ei hatal o ganlyniad i fethiant i ddychwelyd ffurflen dreth (“gwybodaeth berthnasol”).

(2)Mae person yn datgelu gwybodaeth berthnasol drwy—

(a)dweud wrth ACC amdani,

(b)rhoi cymorth rhesymol i ACC feintioli unrhyw dreth ddatganoledig nas talwyd oherwydd i’r wybodaeth gael ei hatal, ac

(c)caniatáu i ACC weld cofnodion at ddiben gwirio faint o dreth ddatganoledig nas talwyd fel hyn.

(3)Wrth ostwng cosb o dan yr adran hon, caiff ACC ystyried—

(a)pa un a oedd y datgeliad wedi ei gymell neu’n ddigymell, a

(b)ansawdd y datgeliad.

(4)Mae datgelu gwybodaeth berthnasol—

(a)yn “ddigymell” os gwneir hynny ar adeg pan nad oes gan y person sy’n datgelu unrhyw reswm i gredu bod ACC wedi darganfod yr wybodaeth berthnasol neu ei fod ar fin ei darganfod, a

(b)fel arall, “wedi ei gymell”.

(5)Mae “ansawdd”, mewn perthynas â datgelu, yn cynnwys amseriad, natur a graddau.
