Emergency Workers (Scotland) Act 2005

Section 6 – Penalties

34.Section 6 provides that a person found guilty of an offence under this Act is liable on summary conviction to a period of imprisonment not exceeding 9 months and/or a fine not exceeding level 5 on the standard scale (currently £5000). This penalty is higher than the current maximum sentence of 3 months imprisonment available at Sheriff Summary level (i.e. for cases which sit without a jury) for common law offences.
