I145Additional powers and duties

The Scottish Ministers may by regulations make provision conferring on approved regulators such additional functions as they consider appropriate for the purposes of this Part.

Before making regulations under subsection (1), the Scottish Ministers must—
a
have the Lord President's agreement, and
b
consult—
i
every approved regulator,
ii
such other person or body as they consider appropriate.
46Guidance on functions
1
In exercising its functions under this Part, an approved regulator must have regard to any guidance issued (to approved regulators generally) by the Scottish Ministers for the purposes of or in connection with this Part.

Before issuing such guidance, the Scottish Ministers must consult—
a
every approved regulator,
b
such other person or body as they consider appropriate.
3
The Scottish Ministers must publish any such guidance as issued (or re-issued).
