1.  Nothing in Article 5 shall render unlawful any act done by any person if—N.I.

(a)it was done before the coming into operation of that Article; or

(b)it was done before the coming into operation of Article 11(5) and it was necessary for him to do it in order to comply with section 106(1) of the Mines Act (Northern Ireland) 1969F12.
