The Electricity (Single Wholesale Market) (2007 Order) (Commencement No. 1) Order (Northern Ireland) 2007

The Department of Enterprise, Trade and Investment, in exercise of the powers conferred by Article 1(3) of the Electricity (Single Wholesale Market) (Northern Ireland) Order 2007(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation, commencement, interpretation and application

1.  This Order may be cited as the Electricity (Single Wholesale Market) (2007 Order) (Commencement No.1) Order (Northern Ireland) 2007.

Appointed Day

2.  5th May 2007 is the day appointed for the coming into operation of the provisions of the Electricity (Single Wholesale Market) (Northern Ireland) Order 2007 listed in column 1 of the Schedule for the purposes set out in column 3 thereof.

SCHEDULEPROVISIONS OF THE ELECTRICITY (SINGLE WHOLESALE MARKET) (NORTHERN IRELAND) ORDER 2007 COMING INTO OPERATION ON 5th MAY 2007

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into operation on 5th May 2007 of the following provisions of the Electricity (Single Wholesale Market) (Northern Ireland) Order 2007-

Article 4 for the purposes of enabling applications for an SEM operator licence to be made.

Article 11 which provides that the Order shall not be a relevant change in law for the purposes of any agreement in force between the holder of a generation licence and any other licence holder which contains provisions relating to a relevant change in law.

Paragraph 2 of Schedule 4 which enables the revocation or suspension of exemptions under the Electricity (Northern Ireland) Order 1992.
