The Energy Act 2008 (Commencement No. 3) Order 2009

The Secretary of State makes the following Order in exercise of the powers conferred by section 110(2) of the Energy Act 2008(1).

Citation

1.  This Order may be cited as the Energy Act 2008 (Commencement No. 3) Order 2009.

Provision coming into force

2.  Section 44(1), (2) and (4) (offshore electricity transmission) of the Energy Act 2008 comes into force on 20th May 2009.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 20th May 2009 section 44(1), (2) and (4) (offshore electricity transmission) of the Energy Act 2008.

Section 44(1) and (2) inserts sections 6D (section 6C: supplemental provision) and 6E (property schemes in respect of offshore transmission licences) into the Electricity Act 1989 (c.29). (Section 6C (competitive tenders for offshore transmission licences) of the Electricity Act 1989 is inserted by section 92 of the Energy Act 2004 (c. 20). Section 92 is being commenced at the same time as section 44(1), (2) and (4) of the Energy Act 2008, by the Energy Act 2004 (Commencement No. 9) Order (2).)

Section 44(4) inserts Schedule 2A (property schemes) into the Electricity Act 1989.
