Amendment of the definition of the Community Recording Equipment Regulation

3.—(1) In each of the provisions specified in paragraph (2), for the definition of “the Community Recording Equipment Regulation” substitute—

the Community Recording Equipment Regulation” means Council Regulation (EEC) No. 3821/85 on recording equipment in road transport(1) as read with the Community Drivers’ Hours and Recording Equipment Regulations 2007(2).

(2) The provisions referred to in paragraph (1) are—

(a)section 97(7) of the Transport Act 1968(3);

(b)regulation 1(3) of the Passenger and Goods Vehicles (Recording Equipment) Regulations 1979(4);

(c)regulation 3(3) of the Passenger and Goods Vehicles (Recording Equipment) (Amendment) Regulations 1984(5);

(d)section 85(1) of the Road Traffic Act 1988(6);

(e)regulation 2(1) of the Passenger and Goods Vehicles (Recording Equipment)(Tachograph Card Fees) Regulations 2005(7); and

(f)regulation 2 of the Passenger and Goods Vehicles (Recording Equipment)(Tachograph Card) Regulations 2006(8).

Impact Assessments generally accompany all UK Government interventions of a regulatory nature that affect the private sector, civil society organisations and public services. They apply regardless of whether the regulation originates from a domestic or international source and can accompany primary (Acts etc) and secondary legislation (SIs). An Impact Assessment allows those with an interest in the policy area to understand:

  • Why the government is proposing to intervene;
  • The main options the government is considering, and which one is preferred;
  • How and to what extent new policies may impact on them; and,
  • The estimated costs and benefits of proposed measures.
