The Welsh Ministers, in exercise of the powers conferred on the National Assembly for Wales by section 4(1)(a) and (2) and section 29(1) of the Local Government Act 1999(1) and now vested in them(2), and having consulted those persons which it is required by section 4(3) of that Act to consult, hereby make the following Order:

Title, coming into force and application

1.—(1) The title of this Order is The Fire and Rescue Authorities (Best Value Performance Indicators) (Wales) Order 2008 and it comes into force on 18 March 2008.

(2) This Order applies only to best value authorities in Wales which are a fire and rescue authority constituted by a scheme to which section 4 of the Fire and Rescue Services Act 2004(3) applies and has effect in relation to the year 2008—2009 and subsequent financial years.

Performance indicators

2.  The performance indicators by reference to which the performance of each fire and rescue authority in Wales will be measured in exercising their functions are hereby specified in—

(a)Schedule 1 (Risk Reduction and Community Safety); and

(b)Schedule 2 (Effective Response).

SCHEDULE 1Risk Reduction and Community Safety

The number of:

i)

Deaths caused by fires per 100,000 population;

ii)

Deaths caused by fires which were started accidentally per 100,000 population;

iii)

Deaths caused by fires which were started deliberately per 100,000 population;

iv)

Injuries (excluding precautionary checks) arising from fires per 100,000 population;

v)

Injuries (excluding precautionary checks) arising from fires which were started accidentally per 100,000 population;

vi)

Injuries (excluding precautionary checks) arising from fires which were started deliberately per 100,000 population.

FRS/RRC/S/003The total number of fires in non-domestic premises per 1,000 non-domestic premises.
FRS/RRC/S/004

i)The number of homes that are within the above average risk category and the well above average risk category (as determined by the Fire Service Emergency Cover model (“FSEC”)) that have received, within the reporting year, a home fire safety risk assessment and are within the five minute service standard.

ii)The number of homes that are within the above average risk category and the well above average risk category (as determined by FSEC) that have received, within the reporting year, a home fire safety risk assessment and are within the ten minute service standard.

iii)The number of homes that are within the above average risk category and the well above average risk category (as determined by FSEC) that have received, within the reporting year, a home fire safety risk assessment and are outside the ten minute service standard.

iv)The total number of fires in homes in which a home fire safety risk assessment and/or associated risk reduction activity had taken place within two years of the fire.

SCHEDULE 2Effective Response

ReferenceIndicator
FRS/EFR/S/001Percentage of fires in dwellings, within the ten minute service standard as identified by each Fire and Rescue Authority, that were attended within ten minutes.
FRS/EFR/S/002Percentage of fires in dwellings, which have been identified by the Fire Service Emergency Cover model as having a casualty rate greater than six, that were attended within five minutes.

Explanatory Note

(This note is not part of the Order)

Part I of the Local Government Act 1999 imposes requirements on fire and rescue authorities and other authorities to secure continuous improvement in the way in which their functions are exercised, having regard to economy, efficiency and effectiveness. Section 4(1) of that Act confers a power on the Welsh Ministers to specify by Order best value performance indicators applicable to fire and rescue authorities and other authorities.

Article 2 of this Order specifies that the performance indicators set out in Schedules 1 and 2 to this Order are to be the indicators by which a fire and rescue authority’s performance will be measured.

A regulatory impact assessment has been prepared in connection with this Order and a copy can be obtained from Fire and Rescue Branch, Community Safety Division, Welsh Assembly Government, Rhydycar, Merthyr Tydfil, CF48 1UZ (telephone 01685 729221).
