Variation of section 153(1) of the Environmental Protection Act 1990

2.  In section 153(1) of the Environmental Protection Act 1990(1) (financial assistance for environmental purposes), after paragraph (z1)(2) add—

“(z2)any programme of measures to achieve, in relation to a body of water, environmental objectives of the kind that may be set in relation to that body of water under Part 1 of the Water Environment and Water Services (Scotland) Act 2003(3) or (as the case may be) schedule 1 of the Water Environment (Water Framework Directive) (Solway Tweed River Basin District) Regulations 2004(4).”.

There are other variations not relevant to this Order. The requirement to obtain Treasury consent for the giving of financial assistance under section 153(1) was removed by section 55 of the Scotland Act 1998.
