Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. (1)Yn ddarostyngedig i ddarpariaethau canlynol yr adran hon, at ddibenion y Mesur hwn, gwasanaeth iechyd meddwl eilaidd yw–

(a)gwasanaeth ar ffurf triniaeth i anhwylder meddwl unigolyn a ddarperir o dan Ran 1 o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006;

(b)gwasanaeth a ddarperir o dan adran 117 o Ddeddf Iechyd Meddwl 1983;

(c)gwasanaeth gofal cymunedol ei brif ddiben yw diwallu angen sy'n ymwneud ag iechyd meddwl oedolyn;

(d)gwasanaeth a ddarperir i blentyn o dan [F1adrannau 37 i 39 a Rhan 6 o Ddeddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014] a'i brif ddiben yw bodloni angen sy'n ymwneud ag iechyd meddwl y plentyn hwnnw.

(2)At ddibenion is-adran (1), nid yw gwasanaeth i'w ystyried fel un a ddarperir o dan Ran 1 o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006 os darperir ef–

(a)o dan adran 41 o'r Ddeddf honno;

(b)o dan gontract gwasanaethau meddygol cyffredinol yr ymrwymwyd ynddo gan Fwrdd Iechyd Lleol o dan adran 42 o'r Ddeddf honno;

(c)o dan drefniadau ar gyfer darparu gwasanaethau meddygol sylfaenol yr ymrwymwyd ynddynt gan Fwrdd Iechyd Lleol o dan adran 50 o'r Ddeddf honno;

(d)o dan Atodlen 1 i'r Ddeddf honno.

(3)Mae gwasanaeth ar ffurf triniaeth ar gyfer anhwylder meddwl unigolyn yn cynnwys gwasanaeth sydd, ym marn y person sy'n darparu neu sy'n gwneud trefniadau ar gyfer darparu'r gwasanaeth, yn wasanaeth y bwriedir iddo drin yr anhwylder meddwl yr amheuir ei fod gan yr unigolyn sy'n cael y gwasanaeth.

(4)Caiff Gweinidogion Cymru, drwy orchymyn–

(a)pennu gwasanaethau eraill sydd i'w hystyried yn wasanaethau iechyd meddwl eilaidd at ddibenion unrhyw un neu ragor o ddarpariaethau'r Mesur hwn;

(b)darparu bod gwasanaethau a fyddai fel arall yn cael eu hystyried yn wasanaethau iechyd meddwl eilaidd i beidio a chael eu hystyried felly at ddibenion unrhyw un neu ragor o ddarpariaethau'r Mesur hwn.
