52Gorchmynion a rheoliadau

(1)Mae unrhyw bŵer sydd gan Weinidogion Cymru i wneud gorchymyn neu reoliadau o dan y Mesur hwn yn arferadwy drwy offeryn statudol.

(2)Mae unrhyw bŵer sydd gan Weinidogion Cymru i wneud gorchymyn neu reoliadau o dan y Mesur hwn yn cynnwys pŵer–

(a)i wneud darpariaeth wahanol ar gyfer achosion neu ddosbarthau o achosion gwahanol, ardaloedd gwahanol neu at ddibenion gwahanol;

(b)i wneud darpariaeth yn gyffredinol neu'n ddarostyngedig i esemptiadau neu eithriadau penodol neu'n unig mewn perthynas ag achosion neu ddosbarthau penodol o achos;

(c)i wneud y cyfryw ddarpariaeth gysylltiedig, atodol, darfodol, canlyniadol, trosiannol neu arbed ag y gwêl Gweinidogion Cymru'n dda ei gwneud.

(3)Mae unrhyw offeryn statudol sy'n cynnwys rheoliadau a wneir o dan y Mesur hwn neu orchymyn o dan adran 53(3)(b) yn ddarostyngedig i'w ddirymu yn unol â phenderfyniad gan Gynulliad Cenedlaethol Cymru.

(4)Nid yw is-adran (3) yn gymwys i reoliadau a gorchmynion y mae is-adrannau (5) a (6) yn gymwys iddynt.

(5)Rhaid peidio â gwneud offeryn statudol sy'n cynnwys (yn unigol neu ynghyd a darpariaeth arall)–

(a)gorchymyn o dan adran 49(4) neu adran 53(3)(a); neu

(b)rheoliadau o dan adran 7(6)(a), 23(1)(b), 23(2), 45 neu 46,

onid oes drafft o'r offeryn wedi ei osod gerbron Cynulliad Cenedlaethol Cymru, a'i gymeradwyo ganddo drwy benderfyniad.

(6)Rhaid peidio a gwneud offeryn statudol sy'n cynnwys (yn unigol neu ynghyd â darpariaethau eraill) y rheoliadau cyntaf i gael eu gwneud o dan adran 18(1)(c) neu 18(8) onid oes drafft o'r offeryn wedi ei osod gerbron Cynulliad Cenedlaethol Cymru, a'i gymeradwyo ganddo drwy benderfyniad.
