8Dyletswyddau i gynnal asesiadau iechyd meddwl sylfaenol: atgyfeiriadau gofal iechyd meddwl eilaidd

(1)Mae'r adran hon yn gymwys i unigolyn sy'n dod o fewn unrhyw un neu ragor o'r disgrifiadau canlynol–

(a)unigolyn sy'n agored i gael ei gadw'n gaeth o dan Ddeddf Iechyd Meddwl 1983;

(b)unigolyn sy'n ddarostyngedig i warcheidiaeth o dan y Ddeddf honno;

(c)unigolyn sy'n glaf cymunedol o fewn yr ystyr a roddir gan adran 17A o'r Ddeddf honno;

(d)unigolyn sy'n cael gwasanaethau iechyd meddwl eilaidd.

(2)Rhaid i asesiad iechyd meddwl sylfaenol gael ei gynnal mewn cysylltiad â'r unigolyn yn unol ag adran 9–

(a)os bydd y cynllun perthnasol yn darparu o dan adran 2(4)(b) fod asesiadau iechyd meddwl sylfaenol i fod ar gael mewn cysylltiad â'r holl gategorïau neu â chategorïau penodedig o unigolion y cyfeirir atynt yn is-adran (1);

(b)os bydd yr unigolyn yn dod o fewn y disgrifiad yn y cynllun o'r unigolion hynny y mae asesiadau iechyd meddwl sylfaenol i fod ar gael mewn cysylltiad â hwy; a

(c)os gwneir atgyfeiriad perthnasol at ddibenion yr adran hon.

(3)Ystyr atgyfeiriad perthnasol at ddibenion yr adran hon yw cais am i unigolyn gael asesiad iechyd meddwl sylfaenol sy'n bodloni'r amodau canlynol.

(4)Yr amod cyntaf yw bod y cais yn cael ei wneud i bartner iechyd meddwl lleol ar gyfer ardal yr awdurdod lleol lle y mae'r unigolyn fel arfer yn preswylio.

(5)Yr ail amod yw bod y cais yn cael ei wneud gan aelod o staff sy'n dod o fewn categori a bennir yn y cynllun ar gyfer yr ardal awdurdod lleol honno o dan adran 2(5).
