11Cynigion gan awdurdodau lleol i ffedereiddio ysgolion

(1)Caiff awdurdod lleol wneud cynigion i ffedereiddio—
(a)dwy neu ragor o ysgolion a gynhelir;
(b)ffederasiwn sy'n bodoli eisoes ac un neu ragor o ysgolion a gynhelir;
(c)dau neu ragor o ffederasiynau sy'n bodoli eisoes.
(2)Rhaid i awdurdod lleol gyhoeddi cynigion a wneir o dan yr adran hon.
(3)Rhaid i awdurdod lleol, yn unol â rheoliadau, ymgynghori â'r personau canlynol ar y cynigion a gyhoeddir—
(a)cyrff llywodraethu ysgolion neu ffederasiynau i'w ffedereiddio;
(b)staff yr ysgolion;
(c)un neu ragor o gyrff (os oes) yr ymddengys i'r awdurdod eu bod yn cynrychioli buddiannau staff yr ysgolion;
(d)i'r graddau y mae'n ymarferol, disgyblion a gofrestrwyd yn yr ysgolion a'u rhieni.
(4)Nid yw is-adran (2) na (3) yn gymwys mewn perthynas â chynnig ar gyfer ffederasiwn a ffurfir o ysgolion bach yn unig.
(5)Mewn perthynas â chynnig ar gyfer ffederasiwn a ffurfir o ysgolion bach yn unig, rhaid i'r awdurdod lleol, yn unol â rheoliadau, ymgynghori â chyrff llywodraethu'r ysgolion dan sylw.
(6)Ystyr “ysgol fach” yn is-adrannau (4) a (5) yw ysgol a gynhelir sydd, ar y dyddiad y gwneir y cynnig o dan is-adran (1), yn ysgol fach a gynhelir yn ôl y diffiniad mewn gorchymyn o dan adran 15.
(7)Rhaid i awdurdod lleol, yn unol â rheoliadau, benderfynu p'un ai—
(a)cadarnhau cynigion, gyda neu heb addasiad neu'n ddarostyngedig i ddigwyddiad, neu
(b)eu tynnu'n ôl.
(8)Caiff awdurdod lleol wneud cynigion ar gyfer ffederasiwn sy'n cynnwys ysgol a gynhelir a honno'n ysgol nad yw'n ei chynnal cyhyd â bod yr awdurdod lleol sy'n cynnal yr ysgol yn cydsynio.
(9)Caiff awdurdod lleol wneud cynigion ar gyfer ffederasiwn sy'n cynnwys ysgol sefydledig neu wirfoddol cyhyd â bod y personau canlynol yn cydsynio—
(a)yn achos un o ysgolion yr Eglwys yng Nghymru neu un o ysgolion yr Eglwys Gatholig Rufeinig, yr awdurdod esgobaethol priodol, a
(b)yn achos unrhyw ysgol sefydledig neu wirfoddol arall, y person neu'r personau y penodwyd y llywodraethwyr sefydledig ganddynt.
(10)Caiff rheoliadau wneud darpariaeth bellach ynghylch cynigion o dan yr adran hon ac (ymhlith pethau eraill) gwneud darpariaeth ynghylch—
(a)sicrhau cydsyniad personau rhagnodedig i wneud, cyhoeddi neu gadarnhau cynigion;
(b)yr wybodaeth sydd i'w chynnwys yn y cynigion, neu sydd i'w darparu mewn perthynas â hwy;
(c)cyhoeddi cynigion;
(d)ymgynghori ynghylch y cynigion;
(e)gwneud gwrthwynebiadau i'r cynigion neu sylwadau ar y cynigion;
(f)tynnu'r cynigion yn ôl neu eu haddasu;
(g)y modd y mae'r awdurdod lleol i gadarnhau'r cynigion.
