The Appropriation (No. 2) (Northern Ireland) Order 1998

Whereas a draft of this Order has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, in exercise of the powers conferred by paragraph 1 of Schedule 1 to the [1974 c. 28.] Northern Ireland Act 1974 and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Title and commencement

1.  This Order may be cited as the Appropriation (No. 2) (Northern Ireland) Order 1998 and shall come into operation forthwith.

Interpretation

2.  The [1954 c. 33 (N.I.).] Interpretation Act (Northern Ireland) 1954 shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

Issue of sums out of the Consolidated Fund for the year ended 31st March 1997 and the year ending 31st March 1999

3.—(1) The Department of Finance and Personnel may issue out of the Consolidated Fund and apply towards making good the supply granted to Her Majesty for the service of the year ended on 31st March 1997 the sum of one thousand pounds.

(2) The Department of Finance and Personnel may issue out of the Consolidated Fund and apply towards making good the supply granted to Her Majesty for the service of the year ending on 31st March 1999 the sum of three thousand, seven hundred and fifty-three million, six hundred and thirty-six thousand pounds.

Power for Department of Finance and Personnel to borrow

4.—(1) Subject to paragraph (2), the Department of Finance and Personnel may borrow on the credit of the aforesaid sums, any sum or sums not exceeding in the whole one thousand, eight hundred and seventy-seven million pounds.

(2) Any money so borrowed shall be repaid, with any interest due thereon, out of the Consolidated Fund at any date not later than 31st March 1999.

Appropriation of grants

5.—(1) The sum granted by Article 3(1) out of the Consolidated Fund is appropriated for the services and purposes specified in Part I of Schedule 1.

(2) The sum already authorised to be appropriated in aid for the year ended on 31st March 1997 shall be increased by the sum specified in the third column of Part I of Schedule 1 for the service in connection with which that sum is specified.

(3) The sum granted by Article 3(2) out of the Consolidated Fund is appropriated for the several services and purposes specified in Part II of Schedule 1.

(4) In addition to the sum granted by Article 3(2) out of the Consolidated Fund, there may be applied as appropriations in aid of the grants for the several services and purposes specified in Part II of Schedule 1, the sums respectively specified in the third column.

Repeal of spent enactments

6.  The enactments mentioned in Schedule 2 are hereby repealed to the extent specified in the third column of that Schedule.

This Order authorises the issue out of the Consolidated Fund of Northern Ireland of further sums for the year ended on 31st March 1997 and the year ending on 31st March 1999 and appropriates those sums for specified services in Northern Ireland. It also authorises the application of certain sums as appropriations in aid for the year ending on 31st March 1999 and increases a sum authorised to be applied as an appropriation in aid for the year ended on 31st March 1997. In addition the Order repeals certain spent enactments.
