Citation and extent1

This Order may be cited as the Welfare Reform and Work (Northern Ireland) Order 2016.

This Order extends to Northern Ireland only.

Commencement2

Except as provided by paragraph (2), the provisions of this Order come into force on such day or days as the Department may by order appoint.

The following provisions come into force on the day after the day on which this Order is made—

a

Article 1, this Article and Articles 3 and 4;

b

Article 5 for the purposes of making regulations;

c

Articles 6 to 8;

d

Articles 17 to 22.

An order under paragraph (1) may make such transitory or transitional provision or savings as the Department considers necessary or expedient.

Interpretation3

In this Order—

  • the Administration Act” means the Social Security Administration (Northern Ireland) Act 1992;

  • the Contributions and Benefits Act” means the Social Security Contributions and Benefits (Northern Ireland) Act 1992;

  • the Department” means the Department for Communities;

  • the Jobseekers Order” means the Jobseekers (Northern Ireland) Order 1995;

  • prescribed” means prescribed by regulations;

  • regulations” means regulations made by the Department;

  • the 2007 Act” means the Welfare Reform Act (Northern Ireland) 2007;

  • the 2015 Order” means the Welfare Reform (Northern Ireland) Order 2015.

Transitory provision4

Article 4 of the 2015 Order (transitory provision) applies in relation to this Order as it applies in relation to the 2015 Order.

Accordingly, in that Article—

a

in paragraph (1)(a) after “this Order” insert “ or the Welfare Reform and Work (Northern Ireland) Order 2016 ”; and

b

in paragraph (6) at the end add “ or under Article 2(1) of the Welfare Reform and Work (Northern Ireland) Order 2016 ”.
