Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the regulations listed below. The amendments are consequential on the coming into operation of the Jobseekers (Northern Ireland) Order 1995 (“the Order”), which replaces income support for the unemployed and unemployment benefit with jobseeker’s allowance. The Regulations replace references to unemployment benefit with references to jobseeker’s allowance, and add references to jobseeker’s allowance where the existing regulations refer to income support.

The Regulations amended by these Regulations are—

(a)the Social Security (Benefit) (Married Women and Widows Special Provisions) (Northern Ireland) Regulations 1975;

(b)the Social Security (Airmen’s Benefits) Regulations (Northern Ireland) 1975;

(c)the Social Security (Mariners' Benefits) Regulations (Northern Ireland) 1975;

(d)the Social Security Benefit (Dependency) Regulations (Northern Ireland) 1977;

(e)the Social Security Benefit (Persons Residing Together) Regulations (Northern Ireland) 1977;

(f)the Social Security (Graduated Retirement Benefit) (No. 2) Regulations (Northern Ireland) 1978;

(g)the Social Security Benefit (Persons Abroad) Regulations (Northern Ireland) 1978;

(h)the Social Security Benefit (Computation of Earnings) Regulations (Northern Ireland) 1978;

(i)the Child Benefit (General) Regulations (Northern Ireland) 1979;

(j)the Social Security (Overlapping Benefits) Regulations (Northern Ireland) 1979;

(k)the Social Security (Widow’s Benefit and Retirement Pensions) Regulations (Northern Ireland) 1979;

(l)the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations (Northern Ireland) 1984;

(m)the Family Credit (General) Regulations (Northern Ireland) 1987;

(n)the Social Security (Payments on account, Overpayments and Recovery) Regulations (Northern Ireland) 1988;

(o)the Social Security (Recoupment) Regulations (Northern Ireland) 1990;

(p)the Social Security (Attendance Allowance) Regulations (Northern Ireland) 1992;

(q)the Social Security (Disability Living Allowance) Regulations (Northern Ireland) 1992;

(r)the Disability Working Allowance (General) Regulations (Northern Ireland) 1992;

(s)the Child Support (Maintenance Assessment Procedure) Regulations (Northern Ireland) 1992;

(t)the Child Support (Maintenance Assessments and Special Cases) Regulations (Northern Ireland) 1992;

(u)the Child Support (Arrears, Interest and Adjustment of Maintenance Assessments) Regulations (Northern Ireland) 1992;

(v)the Child Support Fees Regulations (Northern Ireland) 1993;

(w)the Social Security (Incapacity Benefit — Increases for Dependants) Regulations (Northern Ireland) 1994;

(x)the Social Security (Incapacity for Work) (General) Regulations (Northern Ireland) 1995.

A number of regulations are revoked by these Regulations. In particular, most of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations (Northern Ireland) 1984 are revoked. The revocations are listed in the Schedule.

Article 39 of the Order, the enabling provision under which these Regulations are made, is brought into operation, for the purpose only of authorising the making of the Regulations, on 5th February 1996 by virtue of the Jobseekers (1995 Order) (Commencement No. 1) Order (Northern Ireland) 1996 (S.R. 1996 No. 26 (C. 3)). Since these Regulations are made before the end of a period of 6 months from the commencement of the said Article 39, they are, accordingly, exempt, by virtue of section 150(5)(b) of the Social Security Administration (Northern Ireland) Act 1992 (c. 8), from reference to the Social Security Advisory Committee.
