The Department of the Environment, in exercise of the powers conferred on it by Articles 61(6), 62, 63(5), 75(8), 81(8) and (9) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Motor Vehicle Testing (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 20th April 1998.
2.—(1) The Motor Vehicle Testing Regulations (Northern Ireland) 1995(2) shall be amended as provided in paragraphs (2) to (4).
(2) In regulation 2(1) (interpretation), in the definition of “agricultural motor vehicle”, after the words ““pedestrian controlled vehicle”” there shall be inserted ““rigid vehicle”,”.
(3) In regulation 6 (exemptions), in paragraph (1)(x), for the words “regulation 5” there shall be substituted “regulation 2”.
(4) In Schedule 1(3) (fees), in paragraph 3, for sub-paragraph (h) there shall be substituted—
“(h)Goods vehicle over 3,500 kilograms maximum gross weight—
(i)2 axle rigid vehicle ... ... ... ... £28·00
(ii)3 axle rigid vehicle ... ... ... ... £30·00
(iii)any other vehicle ... ... ... ... £32·50”.

These Regulations further amend the Motor Vehicle Testing Regulations (Northern Ireland) 1995 by amending fees payable for certain goods vehicles which are required to have a full inspection under Article 81 of the Road Traffic (Northern Ireland) Order 1995 (where driving of a defective vehicle on a road has been prohibited). These Regulations make the following principal change—
The fees payable for a full inspection of goods vehicles over 3,500 kilograms maximum gross weight are now divided into 3 categories and the previous single fee of £32·50 has been reduced as follows—
(a)for a rigid vehicle with 2 axles, to £28·00; and
(b)for a rigid vehicle with 3 axles, to £30·00.
The fee for any other vehicle remains unchanged at £32·50.
