The Department of Health and Social Services, in exercise of the powers conferred on it by Article 14(1) and (4) of the Health and Personal Social Services (Northern Ireland) Order 1991(1), and all other powers enabling it in that behalf, and with the consent of the Department of Finance and Personnel in accordance with Article 14(8) of that Order, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Health and Social Services Trusts (Originating Capital Debt) Order (Northern Ireland) 1999 and shall come into operation on 22nd March 1999.

Originating capital debt of the Ulster Community and Hospitals Trust

2.—(1) The originating capital debt of the Ulster Community and Hospitals Trust(2) shall be the amount specified in column 2 of the Schedule.

(2) The originating capital debt specified in column 2 of the Schedule shall be divided between an initial loan of an amount specified in column 3 and public dividend capital of an amount specified in column 4.

Amendments

3.—(1) In the Schedule to the Health and Social Services Trusts (Originating Capital Debt) Order (Northern Ireland) 1994(3), there shall be deleted reference to the originating capital debt, interest bearing debt and public dividend capital of the Ulster, North Down and Ards Hospitals HSS Trust(4).

(2) In the Schedule to the Health and Social Services Trusts (Originating Capital Debt) Order (Northern Ireland) 1995(5) there shall be deleted reference to the originating capital debt, interest bearing debt and public dividend capital of the North Down and Ards Community HSS Trust(6).

Explanatory Note

(This note is not part of the Order.)

This Order determines the amount of the originating capital debt provided for in Article 14(1) of the Health and Personal Social Services (Northern Ireland) Order 1991 of the Ulster Community and Hospitals Trust and provides for the splitting of the originating capital debt into interest bearing loan and public dividend capital. The Order also amends the Health and Social Services Trusts (Originating Capital Debt) Order (Northern Ireland) 1994 and the Health and Social Services Trusts (Originating Capital Debt) Order (Northern Ireland) 1995.
