Importation of Animals (Amendment) Order (Northern Ireland) 1999

The Department of Agriculture, in exercise of the powers conferred on it by Articles 5(1), 19(e), (f), (i) and (k), 20(1) and (2), 21(a), 24(1) and (1A), 29(1) and (2) and 60(1) and paragraph 2 of Part II and paragraph 1 of Part III of Schedule 3 to, the Diseases of Animals (Northern Ireland) Order 19811and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Importation of Animals (Amendment) Order (Northern Ireland) 1999 and shall come into operation on 13th May 1999.

Amendment of the Importation of Animals Order (Northern Ireland) 19862

The Importation of Animals Order (Northern Ireland) 19862 shall be amended as provided in Articles 3 to 9.

Interpretation3

In Article 2—

a

the definitions of “quarantine station” and “reception centre” shall be omitted;

b

after the definition of “master” there shall be inserted the following definition—

  • “place of destination” means the place to which the animals are consigned immediately following importation and which is recorded on the health certificate accompanying the animals;

Further provisions relating to the landing of an imported animal at a landing place4

In Article 6(2) for the word “quarantined” there shall be substituted the word “isolated”.

Application of certain provisions of Schedule 3 to the Diseases of Animals (Northern Ireland) Order 1981 to imported animals5

For Article 7 there shall be substituted the following Article—

The provisions of paragraphs 1 and 2 of Part II of Schedule 3 to the Diseases of Animals (Northern Ireland) Order 1981 shall apply to imported animals.

The provisions of paragraph 1 of Part III of Schedule 3 to the Diseases of Animals (Northern Ireland) Order 1981 shall apply to imported animals subject to the following modifications—

a

the words “or poultry” shall be omitted and for the words “quarantine station” there shall be substituted the words “place of destination”;

b

paragraph 1 shall be renumbered paragraph 1.

and after that sub-paragraph there shall be inserted the following sub-paragraph—

In this paragraph “place of destination” has the same meaning as in the Importation of Animal Order (Northern Ireland) 1986.

Movement of an imported animal after landing6

For Article 8 there shall be substituted the following Article—

After an imported animal has been landed from an aircraft, vessel, vehicle or container it shall be the duty of the person in charge of such an animal to ensure that—

a

it is moved directly to the place of destination or as directed by a veterinary inspector;

b

it does not, while at a landing place, or during the journey to the place of destination come into contact with any other animal; and

c

the vehicle used for the carriage of the animal to the place of destination is one from which there will be no leakage of liquid matter, or escape of waste fodder, animal dung or other excreta.

Revocation7

Article 9 shall be revoked.

Disease in an imported animal8

In Article 10(1) for the words “a quarantine station or reception centre”; there shall be substituted the words “or place of destination”.

Notice9

In Schedule 3—

a

after the words “shall be”, where they first appear, there shall be inserted “for the following reason/s . . .”;

b

at the end of Part III there shall be inserted “and the following action shall be taken in relation to them . . .”.

This Order amends the Importation of Animals Order (Northern Ireland) 1986 (“the 1986 Order”) by removing the requirement that imported animals must be moved to a quarantine station or reception centre. The Order also amends the terms of the notice prescribed in Schedule 3 to the 1986 Order.
