Benefits not assignable on bankruptcy

18.—(1) On the bankruptcy of any person entitled to benefit under these Regulations, no part of the benefit shall be paid to any trustee or any other person acting on behalf of creditors, except as provided for in paragraph (2).

(2) Where, following the bankruptcy of any person entitled to benefits under these Regulations, the court makes an income payments order under Article 283 of the Insolvency (Northern Ireland) Order 1989(1) that requires the Department to pay all or part of the benefit to the person’s trustee in bankruptcy, the Department shall comply with that order.
