ENVIRONMENTAL PROTECTION

The Department of the Environment, in exercise of the powers conferred on it by Article 1(2) of the Waste and Contaminated Land (Northern Ireland) Order 1997(1) and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974(2) and of every other power enabling it in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Waste and Contaminated Land (1997 Order) (Commencement No. 3) Order (Northern Ireland) 1999.
(2) In this Order “the Order” means the Waste and Contaminated Land (Northern Ireland) Order 1997.
2.—(1) The day appointed for the coming into operation of the provisions of the Order specified in Schedule 1 shall be 19th August 1999.
(2) The day appointed for the coming into operation of the provisions of the Order specified in Schedule 2 shall be 11th March 2000.

This Order brings into operation on 19th August 1999 certain provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 which enable the Department to establish a public register of waste carriers and make provision for persons involved in the transportation of controlled waste to register with the Department as carriers of such waste and other ancillary provisions relating to such carriers.
This Order also brings into operation on 11th March 2000 the remaining provisions of Articles 38 and 42 of the 1997 Order which make it an offence to transport controlled waste without being registered as a carrier or failing to comply with the requirement to produce authority for transporting such waste.

The following provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 have been brought into operation by earlier commencement orders as from the date shown.
