Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend—

  • the Social Security (Incapacity Benefit) Regulations (Northern Ireland) 1994 so that a day in respect of which a person makes a claim for incapacity benefit is not to be treated as a day of incapacity unless the claim is accompanied by the claimant’s and, if appropriate, his dependant’s national insurance number (regulation 2); and

  • the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 so that days in respect of which a claimant is not entitled to a jobseeker’s allowance because he has not provided his and, if appropriate, his dependant’s national insurance number, shall not be, or be part of, a jobseeking period (regulation 3).

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
