ROAD TRAFFIC AND VEHICLES

The Department of the Environment, in exercise of the powers conferred on it by Article 57(2) of the Road Traffic Offenders (Northern Ireland) Order 1996(1) and of every other power enabling it in that behalf, and after consultation with such representative organisations as it thinks fit in accordance with Article 91(1) of that Order, hereby makes the following Order:
1. This Order may be cited as the Road Traffic (Fixed Penalty) (Offences) (Amendment) Order (Northern Ireland) 1999 and shall come into operation on 23rd September 1999.
2. In column (2) of items 26 and 47 of Schedule 1 to the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997(2) the words “except when the offence is committed by the holder of a temporarily restricted licence during a period of restriction” shall be deleted.

This Order reflects the repeal of Article 57(3)(b) of the Road Traffic Offenders (Northern Ireland) Order 1996 by amending the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997 (the 1997 Order). The Order removes the exceptions in items 26 and 47 of Schedule 1 to the 1997 Order. The effect of the amendment is that offences of contravention of a speed limit and the carriage of more than one passenger on a motorcycle during a period of restriction are fixed penalty offences.
