Road Traffic Offenders (Additional Offences and Prescribed Devices) Order (Northern Ireland) 1999

The Department of the Environment, in exercise of the powers conferred on it by Article 23(3) and (9) of the Road Traffic Offenders (Northern Ireland) Order 1996(1) and of every other power enabling it in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Road Traffic Offenders (Additional Offences and Prescribed Devices) Order (Northern Ireland) 1999 and shall come into operation on 8th December 1999.

(2) In this Order—

“the Order of 1996” means the Road Traffic Offenders (Northern Ireland) Order 1996.

Amendment of Article 23(2) of the Road Traffic Offenders (Northern Ireland) Order 1996

2.  In Article 23 of the Order of 1996 (Speeding offences etc: admissibility of certain evidence), in paragraph (2), after sub-paragraph (d) there shall be added the following sub-paragraph—

(e)an office under paragraph (4) of Article 20 of the Roads (Northern Ireland) Order 1993(2) consisting in the contravention of any regulations under that Article relating to the use of the hard shoulder of a motorway..

Prescribed device

3.  The following device is hereby prescribed for the purposes of Article 23 of the Order of 1996—

a device designed or adapted for recording, by photographic or other image recording means, the presence of a motor vehicle on an area of road which is wholly or partially reserved for motor vehicles constructed or adapted to carry more than 28 passengers (exclusive of the driver).

Explanatory Note

(This note is not part of the Order.)

This Order amends Article 23 of the Road Traffic Offenders (Northern Ireland) Order 1996 to add an offence in respect of the contravention of any regulation under Article 20 of the Roads (Northern Ireland) Order 1993 relating to the use of the hard shoulder of a motorway to the offences to which Article 23 applies. It also prescribes as a device which may be used to produce a record admissible as evidence under that Article, a device for recording the presence of motor vehicles on such an area of road by photographic or other image recording means.
