The Fisheries Conservancy Board for Northern Ireland in exercise of the powers conferred on it by Sections 26(1)(1), 37(1)(2) to (3), 51(2), 52(2), 70(1) and (2), 71(2)(g), 72(1), 89, 95(1) and (2), 97, 114(1)(b) and 115(1)(b)(3) of the Fisheries Act (Northern Ireland) 1966(4) and of every other power enabling it in that behalf, with the approval of the Department of Culture, Arts and Leisure(5), hereby makes the following Byelaws:—
1. These Byelaws may be cited as the Fisheries (Amendment No. 2) Byelaws (Northern Ireland) 1999 and shall come into operation on 1st January 2000.
2. The Fisheries Byelaws (Northern Ireland) 1997(6) shall be amended as provided in Byelaws 3 to 5.
3. In Schedule 4 in the list of rainbow trout waters where there is no annual close season for angling of rainbow trout—
(a)under the heading County Antrim there shall be inserted after the reference to “North Woodburn Reservoir” a reference to “Potterswall Reservoir”, and
(b)under the heading County Down there shall be inserted after the reference to “Finnebrogue Fisheries” a reference to “Gibson’s Lough”, and
(c)under the heading County Tyrone for the reference to “Rectory View Trout Fishery” there shall be substituted a reference “Rectory Lodge Trout Fishery”.
4. For Byelaw 72 there shall be substituted—
“72. Subject to Byelaws 73 to 76 the annual close season for angling for salmon, trout and rainbow trout in all waters to which Section 25 of the Act applies shall be from 1st November in each year to the last day of February in the next following year, both dates inclusive.”.
5. For Schedule 1 there shall be substituted the following Schedule:

6. The Fisheries (Licence Duties) Byelaws (Northern Ireland) 1998(7) are hereby revoked.

These Byelaws amend the Fisheries Byelaws (Northern Ireland) 1997. The principal changes are as follows:
1. These Byelaws designate a number of waters as rainbow trout waters for the purposes of Byelaw 76 of the Fisheries Byelaws (Northern Ireland) 1997 (“the principal Byelaws”) which provides that there shall be no close season for angling for rainbow trout in waters so designated. (Byelaw 3)
2. Byelaw 4 corrects Byelaw 72 of the principal Byelaws (annual close season for angling for salmon, trout and rainbow trout) by restricting its application only to those waters to which Section 25 of the Fisheries Act (Northern Ireland) 1966 applies. These are the salmon and inland fisheries of Nothern Ireland other than the fisheries in the Londonderry area.
3. These Byelaws increase the licence duties payable from 1st January 2000 for fishing with rod and line and hand line for salmon and freshwater fish and for commercial fishing engines used for the taking of salmon and freshwater fish other than eels together with the fee payable for a licence which authorises the holder to buy and sell salmon, trout and eels. (Byelaw 5)
