Hill Livestock (Compensatory Allowances) (Amendment) Regulations (Northern Ireland) 1999

The Department of Agriculture being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Hill Livestock (Compensatory Allowances) (Amendment) Regulations (Northern Ireland) 1999 and shall come into operation on 11th March 1999.

Interpretation

2.  The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to a Measure of the Northern Ireland Assembly.

Amendment

3.—(1) The Hill Livestock (Compensatory Allowances) Regulations (Northern Ireland) 1996(4) shall be amended in accordance with this regulation.

(2) In paragraph (1) of regulation 2 (Interpretation)—

(a)the definition of “Regulation 3320/94” shall be revoked; and

(b)after the definition of “Council Regulation 3813/92” there shall be inserted the following definition—

“Council Regulation 1103/97” means Council Regulation (EC) No. 1103/97 on certain provisions relating to the introduction of the EURO;.

(3) In paragraph (4) of regulation 2 there shall be substituted for the phrase “these Regulations” the second time it occurs the following—

  • the Hill Livestock (Compensatory Allowances) (Amendment) (Northern Ireland) Regulations 1999.

(4) In paragraph (1A) of regulation 3 (compensatory allowances for breedings cows and ewes)—

(a)there shall be substituted for “the 1998 Scheme year” the phrase “the 1999 Scheme year”;

(b)in sub-paragraphs (a) and (b)(i), for “£47.50” there shall be substituted “£73.39”;

(c)in sub-paragraph (b)(i), for “£88.70” there shall be substituted “£102.75”; and

(d)in sub paragraphs (b)(ii) and (c), for “£23.75” there shall be substituted “£36.69”.

(5) In paragraph (1B) of regulation 3—

(a)there shall be substituted for “the 1998 Scheme year” the phrase “the 1999 Scheme year”;

(b)in sub-paragraph (a), for “£5.75” there shall be substituted “£8.88”;

(c)in sub-paragraphs (b)(i) and (b)(ii)(aa), for “£3.00” there shall be substituted “£4.64”;

(d)in sub-paragraph (b)(ii)(aa), for “£88.70” there shall be substituted “£102.75”; and

(e)in sub-paragraphs (b)(ii)(bb)

and (b)(iii), for “£2.65” there shall be substituted “£4.09”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Hill Livestock (Compensatory Allowances) Regulations (Northern Ireland) 1996 (“the principal Regulations”) as amended, which comply with the Community Legislation mentioned in the first paragraph of the Explanatory Note thereto.

These Regulations set the rates of payment in respect of the 1999 Scheme year for the annual compensatory allowance for certain breeding cows and ewes payable under regulation 3 of the principal Regulations.
