Coming into operation
The Department for Social Development, in exercise of the powers conferred by sections 2(2), 164(1), (2) and (4), 177(4) and 178(1) of the Pension Schemes (Northern Ireland) Act 19931 and Articles 3(2), 10(3), 41(1), 113(1) and 166(3) of the Pensions (Northern Ireland) Order 19952, and now vested in it3, and of all other powers enabling it in that behalf, hereby makes the following Regulations:
Citation, commencement and interpretation1

These Regulations may be cited as the Occupational and Personal Pension Schemes (Penalties) Regulations (Northern Ireland) 2000 and shall come into operation on 3rd April 2000.

In these Regulations—
“the Audited Accounts Regulations” means the Occupational Pension Schemes (Requirement to obtain Audited Accounts and a Statement from the Auditor) Regulations (Northern Ireland) 19974;
“the Register Regulations” means the Register of Occupational and Personal Pension Schemes Regulations (Northern Ireland) 19975.

The Interpretation Act (Northern Ireland) 19546 shall apply to these Regulations as it applies to an Act of the Assembly.
Amendment of the Audited Accounts Regulations2
In regulation 2 of the Audited Accounts Regulations (requirement of trustees or managers to obtain documents) for paragraph (3) there shall be substituted the following paragraphs—

Where the trustees or managers of a scheme have failed without reasonable excuse to take all such steps as are necessary to secure compliance with either the requirement to obtain accounts audited by the auditor of the scheme or the requirement to obtain an auditor’s statement about contributions to the scheme in accordance with paragraph (1)(a) or (b), they shall be liable to pay to the Authority, within 28 days from the date of its imposition, a penalty not exceeding—
a
£5,000 in the case of an individual; and
b
£50,000 in any other case.

Article 3 of the Order shall apply to a trustee of a scheme in respect of any failure by that trustee to comply with the requirements of paragraph (1)(a) or (b).
Amendment of the Register Regulations3
For regulation 5 of the Register Regulations (offences and penalties) there shall be substituted the following regulation—

Where any person, without reasonable cause, fails to comply with the duty imposed under regulation 6(2) he is guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

Where any person, without reasonable cause, fails to comply with any duty imposed by regulation 2, 3 or 6(3) the Occupational Pensions Regulatory Authority7 may require that person to pay within 28 days a penalty which shall—
a
in the case of an individual, not exceed £1,000; and
b
in any other case, not exceed £10,000.
