The Department of Agriculture and Rural Development(1), in exercise of its powers conferred on it by section 1 of the Seeds Act (Northern Ireland) 1965(2) and of all powers enabling it in that behalf, after consultation with representatives of such interests as appear to it to be concerned, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Seed Potatoes (Crop Fees) Regulations (Northern Ireland) 2000 and shall come into operation on 29th May 2000.

(2) In these Regulations, “the Department” means the Department of Agriculture and Rural Development.

Fees

2.  Every person who makes an application to the Department for the certification of seed potato crops under regulation 5(1) of the Seed Potatoes Regulations (Northern Ireland) 1981(3) shall forward with that application the appropriate fee in accordance with the Schedule.

Revocation

3.  The Seed Potatoes (Crop Fees) Regulations (Northern Ireland) 1999(4) are hereby revoked.

Regulation 2

SCHEDULEFees for the certification of seed potato crops

ApplicationFee

1.  In the case of an application received by the Department on or before 30th May in any calendar year—

(a)where the total area of the crop does not exceed 1 hectare

£33·00

(b)where the total area of the crop exceeds 1 hectare

£16·50 per half hectare or part of a half hectare

2.  In the case of an application received by the Department after 30th May in any calendar year—

(a)where the total area of the crop does not exceed 1 hectare

£49·50

(b)where the total area of the crop exceeds 1 hectare

£24·75 per half hectare or part of a half hectare

Explanatory Note

(This note is not part of the Regulations.)

These Regulations increase the fees payable to the Department of Agriculture and Rural Development in respect of the certification of seed potato crops arising under the Seed Potatoes Regulations (Northern Ireland) 1981 (regulation 2 and the Schedule).

In the case of an application received by the Department on or before 30th May in any calendar year:—

(a)where the total area of the crop does not exceed 1 hectare the fee is increased from £32·00 to £33·00;

(b)where the total area of the crop exceeds 1 hectare the fee is increased from £16·00 to £16·50 per half hectare or part of a half hectare.

In the case of an application received by the Department after 30th May in any calendar year:—

(a)where the total area of the crop does not exceed 1 hectare the fee is increased from £48·00 to £49·50;

(b)where the total area of the crop exceeds 1 hectare the fee is increased from £24·00 to £24·75 per half hectare or part of a half hectare.

The Regulations also revoke the Seed Potatoes (Crop Fees) Regulations (Northern Ireland) 1999 (regulation 3).
