ROADS

Trunk Road T8 (Toome Bypass) Order (Northern Ireland) 2000

Made

19th December 2000

Coming into operation

1st February 2001

WHEREAS the Department for Regional Development(1) in accordance with Article 14(1) of the Roads (Northern Ireland) Order 1993(2) considers it expedient for the purpose of improving the trunk system that the road proposed to be constructed on the route described in Part I of Schedule 1 (in this Order referred to as “the new route”) should be designated a trunk road and that the length of trunk road described in Part II of Schedule 1 should cease to be trunk road;

AND WHEREAS the Department in accordance with Article 68(4) of that Order proposes on the completion of works providing alternative facilities for road traffic to:

(i)abandon the lengths of road described in Part III of Schedule 1;

(ii)stop-up the road described in Part IV of Schedule 1 to vehicular traffic; and

(iii)stop-up the road described in Part V of Schedule 1 to road traffic.

AND WHEREAS the Department in accordance with Article 4(1) of that Order proposes to provide for the construction, as part of the Toome Bypass, of the bridge described in Schedule 2, over the navigable waters of the River Bann in the townland of The Creagh (Etre and Otre), County of Londonderry and Brecart (Main Portion), County of Antrim having taken into consideration the reasonable requirements of navigation over the waters affected by the proposal;

AND WHEREAS notice has been published, served and displayed in compliance with paragraphs 1, 2 and 3 of Schedule 8 to that Order;

AND WHEREAS one objection was received and subsequently withdrawn;

NOW THEREFORE the Department, in exercise of the powers conferred by Articles 4(1) and (2), 14(1) and 68(1), (3) and (5) of the Roads (Northern Ireland) Order 1993 and now exercisable by it(3) and of every other power enabling it in that behalf, hereby orders and directs as follows:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Trunk Road T8 (Toome Bypass) Order (Northern Ireland) 2000 and shall come into operation on 2001.

(2) In this Order “the map” means the drawing numbered 22/17/FP/DO marked “Trunk Road T8 (Toome Bypass) Order (Northern Ireland) 2000” copies of which have been deposited at the Department’s Roads Service offices, Headquarters, Room 2-31, Clarence Court, 10-18 Adelaide Street, Belfast BT2 8GB; Northern Division, Divisional Headquarters, County Hall, Castlerock Road, Coleraine BT51 3HS, County Hall, 182 Galgorm Road, Ballymena BT42 1QG and Antrim Section Office, Crown Buildings, 20 Castle Street, Antrim BT41 4JE; Western Division, Magherafelt Section Office, 30 Station Road, Magherafelt BT45 5DN; at the offices of Antrim Borough Council, The Steeple, Antrim BT41 1BJ and Magherafelt District Council, Council Offices, 50 Ballyronan Road, Magherafelt BT45 6EN; and at the offices of Tidal, Toome House, Main Street, Toomebridge, Co Antrim BT41 3HS.

Direction

2.—(1) The new route shall become trunk road and be part of the Antrim-Cookstown Trunk Road T8.

(2) The length of road described in Part II of Schedule 1 shall cease to be trunk road.

Abandonment

3.—(1) The Department shall carry out such works as it considers necessary for the provision of alternative facilities for road traffic and on completion of the works the length of road described in Part III of Schedule 1 shall be abandoned.

(2) All existing cables, wires, mains, pipes or other apparatus placed along, across, over or under the abandoned length of road shall be retained.

(3) All existing rights as to the use or maintenance of such cables, wires, mains, pipes or other apparatus shall be preserved.

Stopping-up

4.—(1) The Department shall carry out such works as it considers necessary for the provision of alternative facilities for road traffic and on completion of the works:

(i)the road described in Part IV of Schedule 1 shall be stopped-up to vehicular traffic; and

(ii)the road described in Part V of Schedule 1 shall be stopped-up to road traffic.

(2) The Department shall carry out such works as it considers necessary to prevent or restrict to such extent as the Department thinks fit, access to the roads by road traffic.

Construction of Bridge

5.  The Department shall construct the bridge in the position and with the minimum dimensions both specified in Schedule 2 as part of the Toome Bypass.

Articles 2, 3 and 4

SCHEDULE 1

Part IThe New Route

Approximately 3930 metres of new road in the townlands of The Creagh (Etre and Otre), County of Londonderry and Brecart (Main Portion) and Drumderg, County of Antrim from a point on the existing Trunk Road T8 approximately 160 metres east of its junction with U5106 Blackpark Road extending in a generally south-easterly direction to a point approximately 380 metres east of its junction with C52 Staffordstown Road including three new roundabouts more particularly delineated and coloured red on the map.

Part IILength of Road which will cease to be Trunk Road

Approximately 2130 metres of the present Trunk Road T8 in the townlands of The Creagh (Etre and Otre), County of Londonderry and Toome and Drumderg, County of Antrim from a point approximately 585 metres west of its junction with B18 Creagh Road extending in a generally south-easterly direction to a point approximately 150 metres east of its junction with C52 Staffordstown Road more particularly delineated and edged brown on the map.

Part IIIRoad to be Abandoned

Part of the present Trunk Road T8:

(a)in the townland of The Creagh (Etre and Otre), County of Londonderry, extending in a generally westerly direction for a length of approximately 230 metres from a point approximately 585 metres west of its junction with B18 Creagh Road more particularly delineated coloured yellow and marked A1 on the map; and

(b)in the townland of Drumderg, County of Antrim, extending in a generally easterly direction for a length of approximately 130 metres from a point approximately 150 metres east of its junction with C52 Staffordstown Road more particularly delineated coloured yellow and marked A2 on the map.

Part IVRoad to be Stopped-Up to Vehicular Traffic

U1006 Gloverstown Road in the townlands of Toome and Drumderg at the junction which will exist between it and the new route more particularly delineated coloured purple and marked J1 on the map.

Part VRoad to be Stopped-Up to Road Traffic

B18 Roguery Road in the townland of Brecart (Main Portion);

(a)at lines approximately 30 metres south-west of its junction with U1005 Brecart Road and at the junction which will exist between it and the new route on the northern side more particularly delineated coloured green and marked J2 and J3 respectively on the map; and

(b)at the junction which will exist between it and the new route on the southern side and at a line approximately 200 metres south-west of that junction more particularly delineated coloured green and marked J4 and J5 respectively on the map.

Article 5

SCHEDULE 2Toome Bypass Bridge

Position

The centre line of the bridge shall extend from a point on the west bank of the River Bann approximately 550 metres north of the existing road bridge (Ordnance Survey map co-ordinates 299111 and 391332) to a point on the east bank approximately 550 metres north of the existing road bridge (Ordnance Survey map co-ordinates 299202 and 391306) in the townlands of The Creagh (Etre and Otre), County of Londonderry and Brecart (Main Portion), County of Antrim more particularly delineated and coloured red on the map.

Minimum Dimensions

Minimum span – 90 metres clear between the abutments.

Minimum headway – 3.5 metres above mean river level of 13.5 metres (above ordnance datum) Belfast Mean Sea Level over the full width of the river.

Minimum waterway – 70 metres.

Explanatory Note

(This note is not part of the Order.)

This Order provides:

  • that approximately 3930 metres of new road described in Part I of Schedule 1 and more particularly delineated and coloured red on the map shall become trunk road and be part of the trunk road system;

  • that approximately 2130 metres of the present Trunk Road T8 more particularly delineated and edged brown on the map shall cease to be trunk road; and

  • for the construction of a bridge to carry the new route over the navigable waters of the River Bann approximately 550 metres north of the existing road bridge in the townlands of The Creagh (Etre and Otre), County of Londonderry and Brecart (Main Portion), County of Antrim.

The Order also provides for the stopping-up and abandonment of certain roads.

Other proposed new road junctions and connecting roads which are not the subject of this Order are shown coloured blue on the map for the purpose of clarification.
