Coming into operation

The Lord Chancellor, in exercise of the powers conferred on him by Article 13 of the Magistrates' Courts (Northern Ireland) Order 19811, on the advice of the Magistrates' Courts Rules Committee and after consultation with the Lord Chief Justice, hereby makes the following Rules:—

Citation and commencement1

These Rules may be cited as the Magistrates' Courts (Amendment) Rules (Northern Ireland) 2001 and shall come into operation on 11th January 2002.

Amendment of principal rules2

Rule 143 of the Magistrates' Courts Rules (Northern Ireland) 19842 shall be amended by substituting for paragraph (1) the following new paragraph:

Subject to this Rule, a warrant issued by a resident magistrate or justice of the peace in proceedings upon complaint shall be addressed to the district commander for the police district in which the warrant is issued.

These Rules amend the Magistrates' Courts Rules (Northern Ireland) 1984 (the principal Rules) to substitute a new Rule 143 which provides for warrants in proceedings upon complaint to be sent for execution to the district commander for the police district in which the warrant is issued.

The amendment is required in consequence of the Police (Northern Ireland) Act 2000.
