The Department for Social Development, in exercise of the powers conferred on it by sections 122(1)(a) and (d), 123(1)(e), 132(3) and (4)(b), 133(2)(d) and 171(1), (3) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 19921 and Articles 14(1) and (4)(b), 23 and 36(2) of, and paragraph 1 of Schedule 1 to, the Jobseekers (Northern Ireland) Order 19952, and now vested in it3, and of all other powers enabling it in that behalf, by this statutory rule, which (apart from regulation 2(5)) contains only regulations consequential on the Employment (Northern Ireland) Order 20024 and which is made before the end of a period of six months from the commencement of those provisions, with the consent of the Department of Finance and Personnel5, in so far as regulation 4 is concerned, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Social Security (Paternity and Adoption Amendment) Regulations (Northern Ireland) 2002 and shall come into operation on 8th December 2002.

In these Regulations–

  • “the Housing Benefit Regulations” means the Housing Benefit (General) Regulations (Northern Ireland) 19876;

  • “the Income Support Regulations” means the Income Support (General) Regulations (Northern Ireland) 19877;

  • “the Jobseeker’s Allowance Regulations” means the Jobseeker’s Allowance Regulations (Northern Ireland) 19968.

The Interpretation Act (Northern Ireland) 19549 shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Income Support Regulations2

The Income Support Regulations shall be amended in accordance with paragraphs (2) to (6).

In regulation 2(1) (interpretation)–

a

before the definition of “attendance allowance” there shall be inserted the following definition–

  • “adoption leave” means a period of absence from work on ordinary or additional adoption leave by virtue of Article 107A or 107B of the Employment Rights (Northern Ireland) Order 199610;

b

after the definition of “partner” there shall be inserted the following definition–

  • “paternity leave” means a period of absence from work on leave by virtue of Article 112A of 112B of the Employment Rights (Northern Ireland) Order 199611;

In regulation 5(3A)12 (persons treated as engaged in remunerative work) after “maternity leave” there shall be inserted “, paternity leave or adoption leave”.

In regulation 35(2)(b)13 (earnings of employed earners) after “maternity leave” there shall be inserted “, paternity leave or adoption leave”.

In Schedule 1B14 (prescribed categories of person) after paragraph 14A15 there shall be inserted the following paragraph–

14BPaternity Leave

A person who is entitled to, and is taking, paternity leave and who satisfies either or both of the conditions set out in sub-paragraph (2).

The conditions for the purposes of sub-paragraph (1) are–

a

he is not entitled to statutory paternity pay by virtue of Part XIIZA of the Contributions and Benefits Act16, or to any remuneration from his employer in respect of that leave for the period to which his claim for income support relates;

b

he is entitled to working families' tax credit, disabled person’s tax credit or housing benefit on the day before that leave begins.

In this paragraph “remuneration” means payment of any kind.

In Schedule 9 (sums to be disregarded in the calculation of income other than earnings)–

a

in paragraph 4–

i

for “Part II of the Social Security (Northern Ireland) Order 1982 or statutory maternity pay under Part VI of the Order” there shall be substituted “Part XI of the Contributions and Benefits Act, statutory maternity pay under Part XII of that Act, statutory paternity pay under Part XIIZA of that Act, statutory adoption pay under Part XIIZB of that Act17”;

after “unable to work due to illness or maternity” there shall be inserted “or who is taking paternity leave or adoption leave”;

b

in paragraph 4A18 for “or statutory maternity pay under Part V of the Social Security Act 1986” there shall be substituted “, statutory maternity pay under Part 12 of the Social Security Contributions and Benefits Act 199219, statutory paternity pay under Part 12ZA of that Act20 or statutory adoption pay under Part 12ZB of that Act21”.

Amendment of the Jobseeker’s Allowance Regulations3

The Jobseeker’s Allowance Regulations shall be amended in accordance with paragraphs (2) to (5).

In regulation 1(2) (interpretation)–

a

before the definition of “attendance allowance” there shall be inserted the following definition–

  • “adoption leave” means a period of absence from work on ordinary or additional adoption leave by virtue of Article 107A or 107B of the Employment Rights (Northern Ireland) Order 1996;

b

after the definition of “part-time student” there shall be inserted the following definition–

  • “paternity leave” means a period of absence from work on leave by virtue of Article 112A or 112B of the Employment Rights (Northern Ireland) Order 1996;

In regulation 52(1) (persons treated as engaged in remunerative work) after “maternity leave” there shall be inserted “, paternity leave, adoption leave”.

In regulation 98(2)(c) (earnings of employed earners) after “maternity leave” there shall be inserted “, paternity leave, adoption leave”.

In Schedule 6 (sums to be disregarded in the calculation of income other than earnings)–

a

in paragraph 4–

i

before “statutory sick pay” there shall be inserted “statutory paternity pay by virtue of Part XIIZA of the Benefits Act, statutory adoption pay by virtue of Part XIIZB of the Benefits Act,”;

ii

after “unable to work due to illness or maternity” there shall be added “or who is taking paternity leave or adoption leave”;

b

in paragraph 5 after “Social Security Contributions and Benefits Act 1992” there shall be inserted “, statutory paternity pay under Part 12ZA of that Act or statutory adoption pay under Part 12ZB of that Act”.

Amendment of the Housing Benefit Regulations4

The Housing Benefit Regulations shall be amended in accordance with paragraphs (2) to (6).

In regulation 2(1) (interpretation)–

a

before the definition of “advanced education” there shall be inserted the following definition–

  • “adoption leave” means a period of absence from work on ordinary or additional adoption leave by virtue of Article 107A or 107B of the Employment Rights (Northern Ireland) Order 1996;

b

after the definition of “partner” there shall be inserted the following definition–

  • “paternity leave” means a period of absence from work on leave by virtue of Article 112A or 112B of the Employment Rights (Northern Ireland) Order 1996;

In regulation 4(6)22 (remunerative work) after “maternity leave” there shall be inserted “, paternity leave or adoption leave”.

In regulation 21A23 (treatment of child care charges) for paragraphs (7) and (8)24 there shall be substituted the following paragraphs–

For the purposes of paragraph (1) a person on maternity leave, paternity leave or adoption leave shall be treated as if he is engaged in remunerative work for the period specified in paragraph (8) (“the relevant period”), provided that–

a

in the week before the period of maternity leave, paternity leave or adoption leave began he was in remunerative work;

b

the claimant incurred relevant child care charges within the meaning of paragraph (2) in that week, and

c

he is entitled to maternity allowance under section 35 of the Contributions and Benefits Act, statutory maternity pay under section 160 of that Act, statutory paternity pay under section 167ZA or 167ZB of that Act25, statutory adoption pay under section 167ZL of that Act26 or qualifying support.

For the purposes of paragraph (7) the relevant period shall begin on and include the day on which the person’s maternity leave, paternity leave or adoption leave commences and shall end on–

a

the date that leave ends;

b

if no tax credit is in payment on the date that entitlement to maternity allowance, statutory maternity pay, statutory paternity pay, statutory adoption pay or qualifying support ends, the date that entitlement ends, or

c

if a tax credit is in payment on the date that entitlement to maternity allowance, statutory maternity pay, statutory paternity pay, statutory adoption pay or qualifying support ends, the date that entitlement to that award of the tax credit ends,

whichever shall occur first.

In–

a

paragraphs (7) and (8) “qualifying support” means income support to which that person is entitled by virtue of paragraph 14B of Schedule 1B to the Income Support (General) Regulations (Northern Ireland) 198727 (paternity leave);

b

paragraph (8) “tax credit” means either working families' tax credit or a disabled person’s tax credit provided that a childcare tax credit under either regulation 46(1)(c) of the Family Credit (General) Regulations (Northern Ireland) 198728 (determination of appropriate maximum working families' tax credit) or, as the case may be, regulation 51(1)(aa) of the Disability Working Allowance (General) Regulations (Northern Ireland) 199229 (determination of appropriate maximum disabled person’s tax credit) forms part of the entitlement to either of those credits.

Where paragraph (7) applies to a person on maternity leave, paternity leave or adoption leave any child care charges in respect of the child to whom such leave relates shall not be treated as relevant child care charges for the purposes of this regulation and regulation 21 (calculation of income on a weekly basis).

In regulation 28(1) (earnings of employed earners)–

a

in sub-paragraph (i)30 for “or statutory maternity pay” there shall be substituted “, statutory maternity pay, statutory paternity pay or statutory adoption pay”;

b

in sub-paragraph (k)31 after “maternity leave” there shall be inserted “, paternity leave or adoption leave”.

In regulation 29(3)(d)32 (calculation of net earnings of employed earners) for “or statutory maternity pay” there shall be substituted “, statutory maternity pay, statutory paternity pay or statutory adoption pay”.

These Regulations further amend the Income Support (General) Regulations (Northern Ireland) 1987, the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 and the Housing Benefit (General) Regulations (Northern Ireland) 1987 (“the principal Regulations”).

Regulations 2(2), 3(2) and 4(2) insert definitions of “adoption leave” and “paternity leave” in the principal Regulations.

Regulations 2(3), 3(3) and 4(3) amend the principal Regulations to provide that a person on statutory paternity leave or statutory adoption leave shall not be treated as engaged in remunerative work for the purposes of the principal Regulations.

Regulations 2(4) and 3(4) amend the Income Support (General) Regulations (Northern Ireland) 1987 and the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 to provide that remuneration received while on statutory paternity or statutory adoption leave is not counted as earnings for the purposes of calculating entitlement to income support or jobseeker’s allowance.

Regulation 2(5) extends entitlement to income support to a person who is entitled to and taking paternity leave by virtue of section 112A or 112B of the Employment Rights (Northern Ireland) Order 1996 and who satisfies the prescribed conditions.

Regulations 2(6), 3(5) and 4(6) amend the principal Regulations to add statutory adoption pay and statutory paternity pay to those payments in respect of which prescribed sums are to be disregarded in the calculation of income for the purposes of those regulations.

Regulation 4(4) amends the Housing Benefit (General) Regulations (Northern Ireland) 1987 for clarificatory purposes and to provide that–

  • for the purposes of child care charges, a parent on statutory adoption leave or statutory paternity leave is to be treated as being in remunerative work when receiving housing benefit;

  • statutory adoption pay and statutory paternity pay are to be treated as earnings for the purposes of housing benefit.

Since these Regulations (apart from regulation 2(5)) are made before the end of a period of 6 months from the commencement of the relevant provisions in the Employment (Northern Ireland) Order 2002, they are accordingly exempt, by virtue of section 150(5)(b) of the Social Security Administration (Northern Ireland) Act 1992 (“the 1992 Act”), from reference to the Social Security Advisory Committee. Regulation 2(5) corresponds to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the 1992 Act, is not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose any charge on business.
