The Department of Health, Social Services and Public Safety(1), in exercise of the powers conferred on it by sections 3(1)(b) of the Health and Personal Social Services Act (Northern Ireland) 2001(2), and of all other powers enabling it in that behalf, and having consulted the Northern Ireland Social Care Council(3), hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Northern Ireland Social Care Council (Description of Social Care Workers) Order (Northern Ireland) 2003 and shall come into operation on 1st April 2003.

(2) In this Order –

“the Act” means the Health and Personal Social Services Act (Northern Ireland) 2001.

Description of social care workers for the purposes of registration

2.  A person who –

(a)manages or is a member of care staff in a children’s home;

(b)manages a residential care home or a day care setting and is not registered with another professional regulatory body

is hereby specified as a description of social care worker for the purposes of section 3(1)(b) of the Act.

Explanatory Note

(This note is not part of the Order.)

This Order is made under section 3(1)(b) of the Health and Personal Social Services Act (Northern Ireland) 2001 (“the Act”). Under section 3 of the Act the Northern Ireland Social Care Council (“the Council”) must maintain a register of social workers and of social care workers of any other description specified by the Order. This Order specifies managers and care staff in children’s homes and managers of residential care homes and day care settings not registered with other professional regulatory bodies as being social care workers for the purposes of registration under that section.
