The Department of the Environment, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the control and regulation of genetically modified organisms, in exercise of the powers conferred by that section and of all other powers enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Genetically Modified Organisms (Deliberate Release) (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 15th April 2003.
2.—(1) In these regulations –
“the Order” means the Genetically Modified Organisms (Northern Ireland) Order 1991(3);
“the Regulations” means the Genetically Modified Organisms (Deliberate Release) Regulations (Northern Ireland) 2003(4).
(2) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these regulations as it applies to an Act of the Northern Ireland Assembly.
3.—(1) Regulation 37 of the Regulations shall be revoked and replaced as follows.
(2) After Article 22 of the Order there shall be inserted –
22A.—(1) The Department shall appoint a Committee to provide it with advice –
(a)on the exercise of its powers under Articles 8, 9 and 10;
(b)on the exercise of any power under this Order to make regulations,
and on such matters concerning the Department’s functions under this Order as the Department may from time to time direct.
(2) The Chairman and other members of the Committee shall hold and vacate office in accordance with the terms of their appointment.
(3) The Department shall pay to the members of the Committee such remuneration (if any) and such allowances as it may determine.”.

These Regulations revoke and replace Regulation 37 of the Genetically Modified Organisms (Deliberate Release) Regulations 2003 (S.R. 2003 No. 167) on the provisions for appointing an Advisory Committee to assist the Department to exercise its functions under the Genetically Modified Organisms (Northern Ireland) Order 1991 (S.I. 1991/1714 (N.I. 19)).
