The State Pension Credit (2002 Act) (Commencement No. 3) Order (Northern Ireland) 2003

The Department for Social Development, in exercise of the powers conferred on it by section 21(2) of the State Pension Credit Act (Northern Ireland) 2002(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the State Pension Credit (2002 Act) (Commencement No. 3) Order (Northern Ireland) 2003.

(2) In this Order, references to sections and Schedules are, unless the context otherwise requires, to sections of, and Schedules to, the State Pension Credit Act (Northern Ireland) 2002.

Appointed day

2.  The day appointed for the coming into operation of –

(a)section 11 (in so far as it is not already in operation) in relation to paragraphs 1 to 7, 10 and 12 of Schedule 1; and

(b)section 20 and Schedule 3 to the extent that they repeal the provisions specified in the Schedule to this Order,

is 7th April 2003

Explanatory Note

(This note is not part of the Order.)

This Order appoints 7th April 2003 as the day for the coming into operation of section 11 of the State Pension Credit Act (Northern Ireland) 2002 (in so far as it is not already in operation) in relation to paragraphs 1 to 7, 10 and 12 of Schedule 1 to that Act (amendments to the Social Security Administration (Northern Ireland) Act 1992 (c. 8) and to the Social Security (Northern Ireland) Order 1998 (N.I. 10) (“the 1998 Order”) which make provision for claims for, and decisions relating to, state pension credit). It also appoints that day for the coming into operation of section 20 of, and Schedule 3 to, that Act in so far as it relates to certain repeals which are consequential on the coming into operation of the amendments to the 1998 Order.

This Order does not impose a charge on business.

Note as to Earlier Commencement Orders

The following provisions of the State Pension Credit Act (Northern Ireland) 2002 have been brought into operation by the State Pension Credit (2002 Act) (Commencement No. 1) Order (Northern Ireland) 2002 and by the State Pension Credit (2002 Act) (Commencement No. 2) Order (Northern Ireland) 2003. Only section 18 has been brought fully into operation. The other provisions have been brought into operation partially for the purpose only of exercising any power to make regulations or orders.
