DANGEROUS DRUGS

The Department of Health, Social Services and Public Safety(1) in exercise of the powers conferred by sections 7, 10 and 31 of the Misuse of Drugs Act 1971(2) as adapted by section 38 of that Act and now vested in it(3) and of every other power enabling it in that behalf and after consultation with the Advisory Council on the Misuse of Drugs in accordance with section 31(3) of that Act, hereby makes the following Regulations:
1. These Regulations may be cited as the Misuse of Drugs (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 1st July 2003.
2. The Interpretation Act (Northern Ireland) 1954(4) shall apply to these regulations as it applies to an Act of the Northern Ireland Assembly.
3.—(1) The Misuse of Drugs Regulations (Northern Ireland) 2002(5) shall be amended in accordance with paragraphs (2) to (4).
(2) In paragraph 1 of Schedule 2 there shall be inserted –
(a)after “Dihydrocodeinone O-carboxymethyloxime”, “Dihydroetorphine”; and
(b)after “Racemorphan”, “Remifentanil”.
(3) In paragraph 1, of Part I of Schedule 4 there shall be inserted –
(a)after “Haloxazolam”, “4-Hydroxy-n-butyric acid”; and
(b)after “N-Ethylamphetamine”, “Zolpidem”.
(4) In paragraph 1, of Part II of Schedule 4 there shall be inserted –
(a)before “Atamestane”, “4-Androstene-3, 17-dione” and “5-Androstene-3, 17 diol”; and
(b)after “Nandrolene”, “19-Nor-4-Androstene-3, 17 dione” and “19-Nor-5-Androstene-3, 17 diol”.

These Regulations amend the Misuse of Drugs Regulations (Northern Ireland) 2002 by adding two substances to paragraph 1 of Schedule 2 (controlled drugs subject to the requirements of Regulations 14, 15, 16, 18, 19, 20, 21, 23, 26 and 27) two substances to Part I of Schedule 4 (controlled drugs subject to the requirements of Regulations 22, 23, 26 and 27) and four substances to Part II of Schedule 4 (controlled drugs expected from the prohibition on possession when in the form of a medicinal product; excluded from the application of offences arising from the prohibition on importation and exportation when imported or exported in the form of a medicinal product by any person for administration to himself; and subject to the requirements of Regulations 22, 23, 26 and 27).
