Coming into operation

I, The Right Honourable Sir Robert Douglas Carswell, Lord Chief Justice of Northern Ireland, in exercise of the powers conferred on me by section 6 of, and paragraphs 5 and 6 of the Schedule to, the Pensions Appeal Tribunals Act 19431 and of all other powers enabling me in this behalf, do hereby make the following Rules:

Citation, commencement and interpretation1

These Rules may be cited as the Pensions Appeal Tribunals (Northern Ireland) (Amendment) Rules 2003 and shall come into operation on 16th July 2003.

In these Rules a reference to a Rule or Schedule by number is a reference to that Rule or Schedule as numbered in the Pensions Appeal Tribunals (Northern Ireland) Rules 19812.

Amendments to the Pensions Appeal Tribunals (Northern Ireland) Rules 1981

After Rule 4(3) there shall be added the paragraph:

No later than fourteen days after receipt of the notice of appeal the Secretary of State for Defence shall forward a copy of it to the Pensions Appeal Office by first class post.

In Rule 24(1) after the words “entitlement appeal” add the words “or an appeal against a specified decision”.

These rules amend the Pensions Appeal Tribunals (Northern Ireland) Rules 1981 to provide, in rule 4(4), for the Pensions Appeal Office to be served with a copy of the notice of appeal when received by the Secretary of State for Defence and, in rule 24(1), for a procedure for appeals to the Court of Appeal against specified decisions.
