The Education (Grants for Disabled Postgraduate Students) (Amendment) Regulations (Northern Ireland) 2003

The Department for Employment and Learning(1), in exercise of the powers conferred by Articles 3(1) and (2), of the Education (Student Support) (Northern Ireland) Order 1998(2) and now vested in it(3) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (Grants for Disabled Postgraduate Students) (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 1st September 2003.

(2) In these Regulations, “the Principal Regulations” means the Education (Grants for Disabled Postgraduate Students) Regulations (Northern Ireland) 2001(4).

Transitional provisions

2.  These Regulations shall not have effect in relation to an academic year (as defined in regulation 2(6) of the Principal Regulations) which begins before 1st September 2003.

Amendment of the Principal Regulations

3.  In regulation 3(2)(ii) of the Principal Regulations there shall be omitted the words “the amount of which is not calculated by reference to his income”.

4.  Regulation 9(2)(5) of the Principal Regulations shall be amended by substituting “£5370” for “£5245”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Education (Grants for Disabled Postgraduate Students) Regulations (Northern Ireland) 2001, (“the Principal Regulations”).

Regulation 3 of the Principal Regulations is amended to exclude from eligibility for grants those students who are in receipt of an NHS bursary, whether or not this bursary is means tested. Previously, only recipients of means-tested bursaries were excluded.

Regulation 9(2) of the Principal Regulations is amended to increase the maximum amount of grant payable from £5245 to £5370. This increase will not apply to an academic year beginning before 1st September 2003.
