The Department of the Environment, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the testing of the roadworthiness of motor vehicles and their trailers and in exercise of the powers conferred upon it by that section 2(2), and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Road Vehicles (Testing) (Disclosure of Information) Regulations (Northern Ireland) 2003 and shall come into operation on 1st February 2003.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Disclosure of testing information to member State competent authorities

2.  The Department of the Environment may give information about vehicles or persons obtained from inspections carried out under Article 75 or 76 of the Road Traffic (Northern Ireland) Order 1995(4) or under Article 84 of the Road Traffic (Northern Ireland) Order 1981(5) to the competent authorities in other member States, and in Great Britain and Gibraltar, in compliance with Directive 2000/30/EC of the European Parliament and of the Council on the technical roadside inspection of the roadworthiness of commercial vehicles circulating in the Community(6).

Explanatory Note

(This note is not part of the Regulations.)

These Regulations empower the Department of the Environment to give information about vehicles or persons obtained from inspections carried out under Article 75 or 76 of the Road Traffic (Northern Ireland) Order 1995 or Article 84 of the Road Traffic (Northern Ireland) Order 1981 to the competent authorities in other member States, and in Great Britain and Gibraltar, in compliance with Directive 2000/30/EC of the European Parliament and of the Council on the technical inspection of the roadworthiness of commercial vehicles circulating in the Community.
