LEGAL AID AND ADVICE

Legal Advice and Assistance (Amendment No. 2) Regulations (Northern Ireland) 2003

The Lord Chancellor, in exercise of the powers conferred by Articles 22(1) and 27 of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981(1) and now vested in him(2) hereby makes the following Regulations: –

Citation and commencement

1.  These Regulations may be cited as the Legal Advice and Assistance (Amendment No. 2) Regulations (Northern Ireland) 2003 and shall come into operation on 1st April 2003.

Interpretation

2.  In these Regulations “the Principal Regulations” means the Legal Advice and Assistance Regulations 1981(3).

Amendment to the Principal Regulations

3.  The Principal Regulations are amended as follows:

(i)in Regulation 3 the words, “ “disability working allowance” means disability working allowance under the Social Security Contributions and Benefits (Northern Ireland) Act 1992;” and, “ “family credit” means family credit under the Social Security Contributions and Benefits (Northern Ireland) Act 1992;” are deleted,

(ii)in Regulation 5(2)(b) for the words “income support, income-based jobseeker’s allowance, disability working allowance or family credit” there shall be substituted the words “income support or income-based jobseekers allowance”.

(iii)in Regulation 6(2)(b) for the words “income support, income-based jobseeker’s allowance, disability working allowance or family credit” there shall be substituted the words “income support or income-based jobseekers allowance”.

(iv)in Regulation 7(2) for the words “income support, income-based jobseeker’s allowance, disability working allowance or family credit” there shall be substituted the words “income support or income-based jobseekers allowance”.

Amendment to Schedule 4 to the Principal Regulations

4.  In Schedule 4 paragraph (e) the words “, disability working allowance, family credit” are deleted.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Legal Advice and Assistance Regulations (Northern Ireland) 1981 to remove references to obsolete benefits, namely family credit and disability working allowance.
