Coming into operation

The Department for Employment and Learning, in exercise of the powers conferred on it by sections 167ZC(3)(d), 167ZL(8)(d) and 171(1) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 19921, and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Statutory Paternity Pay and Statutory Adoption Pay (General) (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 6th April 2005.

Application2

The amendments to the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations (Northern Ireland) 2002 provided for by regulation 3 shall have effect only in relation to a reinstatement or re-engagement occurring on or after 6th April 2005.

Amendment of the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations (Northern Ireland) 20023

In regulation 34 of the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations (Northern Ireland) 20022 (continuous employment and unfair dismissal), the word β€œor” at the end of paragraph 1(b) shall be omitted and after paragraph (1)(c) there shall be inserted –

of a decision taken arising out of the use of a statutory dispute resolution procedure contained in Schedule 1 to the Employment (Northern Ireland) Order 2003 in a case where, in accordance with the Employment (Northern Ireland) Order 2003 (Dispute Resolution) Regulations (Northern Ireland) 2004, such a procedure applies.

These Regulations amend the Statutory Paternity Pay and Statutory Adoption Pay (General) Regulations (Northern Ireland) 2002 to provide for continuity of employment in respect of a dismissal where a person commences a statutory dispute resolution procedure and as a consequence is reinstated or re-engaged by their employer. The amendment has effect in relation to a reinstatement or re-engagement occurring on or after 6th April 2005.
