The Planning (Amendment) (2003 Order) (Commencement No. 4) Order (Northern Ireland) 2005

27th July 2005

The Department of the Environment, in exercise of the powers conferred by Article 1(2) and (3) of the Planning (Amendment) (Northern Ireland) Order 2003(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Planning (Amendment) (2003 Order) (Commencement No. 4) Order (Northern Ireland) 2005.

Appointed day

2.  The appointed day for the coming into operation of Article 23 of the Planning (Amendment) (Northern Ireland) Order 2003 is 31st August 2005.

Transitional Arrangements

3.  An agreement in force under Article 40 of the Planning (Northern Ireland) Order 1991(2) immediately before Article 23 of the Planning (Amendment) (Northern Ireland) Order 2003 comes into operation has effect from that date as if it were an agreement entered into under that Article 40 as substituted by that Article 23.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order brings into operation on 31st August 2005, Article 23 (Planning Agreements) of the Planning (Amendment) (Northern Ireland) Order 2003. Article 3 includes transitional provisions.
