The Department for Employment and Learning(1), in exercise of the powers conferred on it by Articles 3(1) and 25(5) of the Industrial Tribunals (Northern Ireland) Order 1996(2), and now vested in it(3), and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Industrial Tribunals (Constitution and Rules of Procedure) (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 31st August 2005.

(2) In these Regulations “the principal Regulations” means the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005(4).

Appointment to panel of chairmen

2.—(1) In regulation 4(1)(a) of the principal Regulations, for “the Department” substitute “the Lord Chancellor”.

(2) In regulation 4(2) of the principal Regulations, for “to the Department” substitute “to the Lord Chancellor, in the case of a member of the panel of chairmen, or to the Department, in any other case”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend regulation 4 of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005 (regulation 2). The effect is that the Lord Chancellor, rather than the Department for Employment and Learning, appoints full- and part-time members to the panel of chairmen of industrial tribunals.
